In recent years,our country's economy has developed at a high speed,gradually advancing democratic administration and emphasizing the importance of flexible management in administrative law enforcement.Based on the development of the theory of balance and the theory of public participation,flexible administrative law enforcement with Chinese characteristics has emerged and been widely applied.After many years of development and exploration,administrative interview has been widely used in the fields of consumer protection,price control,environmental protection and network supervision.However,as a non-enforcement method,the theory of administrative interview has not been perfect and systematized.Up to now,the theoretical circle has not been able to unify the administrative interview and its legal effect.In recent years,the application field of administrative interview has been expanding,so it plays an increasingly important role in law enforcement practice and administration.Based on this,it is imperative to clarify its legal attributes and define the concept accurately.In this paper,we try to explore administrative interviews based on various fields,using administrative interviews and relevant legislative texts.In order to meet the needs of administrative management,administrative interviews are used to publicize the rule of law,warning education in the form of consultation and cooperation,equal dialogue,etc.,and to persuade the relative to accept and comply with administrative activities.In addition,this paper,in the light of the special situation of the administrative interview text and the mature practice,defines it as an administrative instruction behavior in the light of the practice of administrative interview and the views of experts and scholars,and has the characteristics of non-mandatory attribute.Based on the background of deepening service administration and cooperative administration,the administrative interview fully reflects the need of innovating law enforcement and transforming administrative management,and it is also the objective requirement to realize the administration according to law and build a service-oriented government.Administrative interview is not only a useful supplement to traditional administrative enforcement,but also reduces administrative enforcement cost while optimizing administrative enforcement level.Moreover,equal communication helps to bring administrative subjects and their counterparts closer together.Current administrative interviews have been widely used in various fields and have initially achieved better enforcement results.However,until today,the legislation has not been perfected,and the relevant theoretical research is still in the groping stage.At present,China has not perfected the legal system of administrative interview,and all aspects need to be improved.We have not yet been able to unify the standard of text and the legal basis has serious problem of excessive and compulsory.The existence of these problems is not conducive to give full play to the advantages of this flexible law enforcement,runs counter to the essence of the administrative interview system,is not conducive to realizing its due value,and hinders the improvement of the legal system of administrative interview.Based on this,this article mainly combines the above practice level and the text standard aspect remaining problem,carries on the comprehensive analysis and research with the relief mechanism,the implementation procedure and the law and regulations,hopes this research can provide certain reference value to the development of the administrative interview legal system.
