Research On The Administrative Interview Problems Of Online Car-Hailing Platform

The rise and rapid development of online car-hailing,bringing great convenience to people’s commuting,at the same time,causes many problems such as online car-hailing platforms illegally sending orders,privacy disclosure of users,lax access restrictions.Therefore,these problems make online car-hailing platforms supervision an important task of current governance of online car-hailing industry.As a kind of flexible law enforcement method in the regulation of online car-hailing platforms,compared with the traditional mandatory administrative law enforcement method,administrative interview of online car-hailing platforms is non-mandatory,flexible,consultative and participatory,it has been highly praised by the administrative supervision authority of online car-hailing platforms,which can not only reduces administrative cost but also improves administrative efficiency in the process of administrative law enforcement.However,the current interview system is immature in the application of the online car-hailing platforms,the interview lacks legal basis,standard interview procedure and supervision and relief.Therefore,it is necessary to conduct an in-depth study on the administrative interview of online car-hailing platforms in order to improve the system related to the administrative interview of online car-hailing platforms.This paper mainly from the perspective of administrative law,analyses and researches the system of China’s online car-hailing platform administrative interview.The main body of the article consists of four parts:The first part is the basic overview of the administrative interview on the online car-hailing platform.By introducing the background of the administrative interview and the supervision of the online car-hailing platform.This part introduces the concept of the administrative interview on the online car-hailing platform,and then analyzes the characteristics and inevitability of the administrative interview on the online car-hailing platform.The second part is the legal inquiry of the administrative interview of online car-hailing platform.In order to analyze the legal attributes,functions and standard requirements.At present,the legal attribute of administrative interview is quite controversial in the academic circle.Based on comprehensive analysis and comparison,this paper believes that the administrative interview of online car-hailing platforms should be classified into special administrative guidance.Then,it discusses the effect of interview in the process of supervising the online car-hailing platform.Finally,from the perspective of basic principles,this paper puts forward the normative requirements for the administrative interview of online car-hailing platforms.The third part is the problems existing in the administrative interview of online car-hailing platforms.This part points out that the main problems existing in the current practice are lack of legal basis,abuse of interview,non-standard interview procedure and imperfect supervision and relief.The fourth part is to construct the system of administrative interview of online car-hailing platform.It is suggested that we should promote the legislation of administrative interview on online car-hailing platforms,improve the standardized procedures of administrative interview on online car-hailing platforms,and strengthen the supervision and relief of administrative interview on online car-hailing platforms.And put forward the immature legislative proposal on this basis.
