The Effective National Investigation Of Anti-domestic Violence Law

Domestic violence,especially the violence against women in China,began to capture wide attention in the fields of media or research in recent years.In the Chinese culture extending over thousands of years,it is widely believed that even an upright official finds it hard to settle a family quarrel,which has justified and even legalized the domestic violence.Anti-domestic Violence Law of the People's Republic of China took effect on March 1 of 2016.It is the first national law against the domestic violence in China.It is also the first time that China has defined domestic violence as no longer being a family issue.Domestic violence is illegal and even constitutes a criminal behavior.Chapter one is mainly devoted to discussing the research background,research object and research methods.Guangze County of Fujian Province has been chosen as the research object for the effectiveness of the anti-domestic violence law over the past year.The survey regarding the implementation of the law has covered the residents in Guangze County,the court in Guangze County,the public security bureau in Guangze County,the Women's Federation in Guangze County as well as three communities in Guangze County.As to the research methods,the author has surveyed the number and category of domestic violence cases handled by the court,public security bureau and the Women's Federation in Guangze County from 2012 to 2016 by means of sampling survey.The author has also conducted the questionnaire(paper-based questionnaire and online questionnaire)to survey the local residents' knowledge about domestic violence and the relevant provisions of the law.Chapter two,collect and analyze the questionnaire by means of data arrangement,statistics and analysis.The chi-square test should be also conducted to analyze whether there is a correlation between relevant problems and thus find out the causeof the problems.Judging from the arrangement,statistics and analysis of the data,the problems regarding the effective implementation of the anti-domestic violence law in Guangze County have been summarized in the third chapter.To be more specific,ordinary residents have a limited understanding of the anti-domestic violence law,namely the incomprehensive publicity of the anti-domestic violence law in Guangze County,the inadequate knowledge of local residents about the law as well as the incomplete transformation of the concept about domestic violence being a family issue.Judging from the survey data of the court,the court has much difficulty in collecting the proof about domestic violence.The law enforcement and judicial authorities have a negative attitude towards intervening in the cases of domestic violence.Judging from the survey data of public security bureau,the traditional concept in China has posed an invisible barrier to the public security authority during the process of dealing with the cases of domestic violence.The special relationship between the victim and the perpetrator has also added to the difficulty of public security authority dealing with the relevant cases.The intervention of the policemen at the grassroots level has not been included in the performance evaluation.All of them are the main problems facing the public security authority during the process of dealing with the cases of domestic violence.From the angle of Women's Federation,it can not play a strong role in protecting the rights and interests of women,which is the main problem facing the Women's Federation during the process of dealing with the cases of domestic violence.As far as the community is concerned,the main problem is that many community workers have lacked the professional knowledge and diverse skills for dealing with the cases of domestic violence.In the fourth chapter,the author has proposed some measures to deal with the problems analyzed above.As pointed out by the author,necessary measures should be taken to better popularize the anti-domestic violence law,enlarge the scope and breadth of law popularization as well as organize the long-term and regular activities for popularizing the law.The provisions about the proof of domestic violence should be completed.The conversion and interaction between the subjects of domestic violence should be emphasized.The duty of public security bureau in preventingdomestic violence should be clearly defined and strengthened.First of all,policemen-measures should be taken to strengthen the anti-domestic violence awareness of relevant authorities and policemen,provide professional training and guidance for policemen,design the performance evaluation procedure for dealing with relevant cases properly as well as establish the archive system for domestic violence.Moreover,the Women's Federation's ability to intervene in the domestic violence should be improved and the shelter for the victims suffering from domestic violence should be set up.An effective mode of intervening in the domestic violence with the participation of the community and various organizations can urge those social organizations to fulfill their functions for dealing with the domestic violence without shifting their responsibility to each other.
