Research On The Reform And Legalization Of Petition In The New Era

The petition is regarded as one of the most characteristic socialist political systems in China.In the new era of comprehensively deepening reform and comprehensively advancing the rule of law,it is an urgent task for us to make steady and in-depth progress in the reform of the legalization of letters and visits.Based on the basic theory of petitions and the rule of law,this paper probes into the basic connotation,intrinsic value,dilemma of reality and its causes and countermeasures.The petition system conforms to the modern rule of law of "good law and cure",and has strong rule of law.The legalization of complaint reporting is to make good laws and regulations and abide by them.It is an important means to build up the credibility of the party and the government.The reality dilemma of the legal system of complaint reporting is manifested in many aspects: first,the function of complaint reporting,the offside and dislocation interweaving;Second,the end of the petition,the imbalance between the right to increase and the right to cut;Third,in the legislation of the petition,progress and lag coexist;Fourth,it is a game of human governance and rule of law.Fifth,the concept of petition,traditional and modern conflict.The reason lies in the unbalanced relationship between "central and local people",the contradiction between rationality and jurisprudence,and the prevalence of rights protection discourse in the era of rule of law.This paper puts forward some Suggestions for the reform of the legal system of petition system.First of all,we should establish the concept of the legal system and speed up the legislative process.Secondly,we will reform the system of petition and visit and rebuild local administrative power.Thirdly,improve the complaint reporting mechanism and explore the feedback path.Finally,strengthen the construction of ideological discourse power,and guide the people's rational rights protection.
