Transformation Of China's Petition Relief System Reform

The paper based on the dilemmas faced by the petition relief system in China's transition, and how to effectively deal with the contradictions and disputes which brought about the social diversity, and analyzing the current situation of China's petition relief system; come up with a reasonable and effective approach for the operation and reform of China's petition that suits China's national conditions.To analyze petition as a duality that based on the function, historical background and theoretical basis of relief system, which is a difficulty and focus in the theory and practice of China's petition. To analyze the relief function of petition, for people, it is a way for people's participation and an instrument for people's safeguarding legal rights; and for government, it is a mechanism for communication and an instrument for maintaining rule and stable order. Petition as a special product of the special times, is facing many difficulties, but still its value. Thus, to play a better role in relief petition, effective reform must be taken.According to the experience of the author who took a temporary position in the grass-roots sector of petition, through thinking about the work of petition of Chong' an district in Wuxi city, and to combine with literature and data, and historical background; deeply analyze various factors which brought about the dilemma of petition system; and to find out its nature; so as to come up with pointedly reform policies.The paper studies the current dilemmas of China's petition from the perspective of law, social science and politics, and proposes five measures about the reform of petition relief system in transition. First, should scientifically define the existing function of the petition. Second, to establish normative legal institutions about petition. Third, the threshold for legal aid must be reduced, and to expand the scope of assistance. Fourth, to make petition work digitalized and networked. Fifth, to strengthen the supervision of public opinion on petition system. Only taking a gradual way of achieving the reform of petition by rule of law, it can play an effective role in petition relief and serve for the building of a harmonious society.
