Onthe Order Of Correction In Labor Security Supervision

"Order correction" is a common concept in China's administrative legislation,but the legal attribute of this act is not clearly defined.There are different views among the legal theoretical field and the administrative practice,resulting in a lack of legal norms and unified procedures for ordering corrective actions,which directly affects the normative and impartiality of law enforcement,as well as the uniformity of the applicable relief procedures,and ultimately affect the protection of workers' rights.This paper takes the order correction action of the labor security supervision as a perspective.First,the article determines the basic concept of the order correction,deduces the basic elements and ways of order correction action and its existing problems from the legal statue of order correction.Secondly,it analyzes that because of the defects legal significance and classification attribution of the correction is not clear,as well as whether it is included in the administrative reconsideration and the administrative litigation,which lead to a variety of adverse in the application process of the order correction action.On this basis,according to the existing problems,the paper puts forward to improve the law enforcement procedures,the supervision mechanism and related remedies through the method of institutionalizations and standardization,aiming at raising the efficiency and execution of order correction actions,and ensuring fair and just law enforcement.
