Administration Legislation Assessment Study

It is by no means easy for China to implement the policy of ruling the country by law and to achieve the goal of building a country under the rule of law. As the Chinese saying goes like this, "success follows well-armed preparation". How to build a comprehensive legal system and bring legislation into line with the implementation is the eternal pursuit of the legal profession, but the implementation of law does not necessarily coincide with the purpose of legislation. They usually play two different tunes. Due to the special legislation conditions in China, some laws with flaw often go unnoticed after they are enacted. Therefore, it has been a common concern in legislative branches and theoretical circles to optimize administration legislation system and improve administration legislation quality. Administrative legislation assessment is a way to optimize legislation system and improve legislation quality. This paper seeks to explore the effective way to improve the legislation quality and achieve the goal of ruling the country by law in a harmonious way. It combines administration legislation assessment case studies which have been carried out abroad with theoretical research in the hope of providing useful lessons for future legislation assessment work . it also aims to improve the present administrative legislation assessment system and enhance its theoretical level.The thesis consists of three parts:The first part gives a general introduction of administration legislation assessment system. A detailed illustration and a comparative study are made to clarify this concept. Then another brief introduction to the assessment history enables us to understand how legislation assessment originated and developed through ages. By analyzing the value of legislation assessment system, it is hoped that more people will be concerned with the establishment and improvement of the present assessment system.The second part discusses the context and present situation of administrative legislation assessment. Background information enables us to explore its specific contexts and connotations in a certain time, so an effective assessment system can be established to meet the demand of the modern times. By studying the present assessment situation and identifying the existing problems, we hope to have a better knowledge of the reality and problems, with a view to find a cure, that is, find the best way to set up a new administrative legislation assessment system which is rooted in traditional Chinese culture background and with typical Chinese characteristics.Part three discusses how to set up a comprehensive administrative legislation system with Chinese characteristics in China. Case studies are made about the present administration legislation assessment practice. Then standards, main bodies, approaches and procedures necessary in assessment system are set up. It is hoped that a certain case study will be enhanced to a theoretical level so that the new assessment system will be theory-based and theory-oriented.
