| The technology changes life violently.No one thought that every household would have an electronic computer two decades ago.And,no one would realize that smart phones will spread to almost everyone in such a short period of time ten years ago.Nowadays shopping,meals,accommodation,transportation,and even housekeeping services can all be realized through software on a single smart phone.The phenomenon of looking for a phone book or posting notices on the bulletin boards in the past is gone forever.The modern way of information exchange solves the problem of information asymmetry that has plagued the market for a long time.Suppliers and demanders can release supply and demand information through the platform instantly so that people can put extra items,seats or even services on hand to the Internet in exchange for the corresponding income.Of course,the travel mode cannot escape from this "sharing"wave.As people’s spending power increases,and the small cars that can greatly increase the happiness index of life are almost essential for every household.A large amount of surplus combined with the sharing platform mentioned above produce the "Ride-hailing"service mentioned in this article.This article explores the theory of online dating vehicles and analyzes the status quo,problems,and experiences of supervision in China and the other countries,and puts suggestions for the improvement of China’s existing network vehicle supervision system.Specifically,it is divided into the following four parts.:The first part explores the theoretical problem of the network vehicle,demonstrates that the theoretical basis for the existence of the network vehicle is sharing economy theory,and its existing reality basis is its irreplaceable role in market economy and urban management.The online tour vehicle can provide people with more diverse travel modes while improving the efficiency of the use of market resources,solving the problem of people’s car use needs and also alleviating the problem of urban traffic congestion.The second part studies the necessity of supervision of online vehicles and the status quo of China’s online vehicle supervision and regulatory issues,including the following:regulatory concepts and regulatory standards are deviating from the development trend of shared economy,and the quality of online dating vehicles is low.There are doubts about the legality of the relevant normative documents and the lack of regulation of unfair competition practices in the online car industry.The third part mainly studies the experience of the extra-territorial state network regulation system.The U.S.created a network by giving them an innovative legal status,conducting strict checks on drivers and vehicle safety,reducing unnecessary restrictions,granting authorization to the platform,strengthening supervision,protecting passengers’right to information,and paying attention to the rights of vulnerable groups.The new model of approving car regulation;the United Kingdom has achieved double wins in industry development and protection of consumer rights through dual-track supervision,a more relaxed access system and a dist:inctive insurance system;the development of a taxi system is very complete in Singapore.The network car and taxi unified supervision,and achieved good results.These systems have important reference values and lessons for our country.The fourth part answers the practical problems of the second part ’based on the extraterritorial experience of the third part,determines the regulatory principles that should be adhered to by the online vehicle regulatory system and the regulatory targets that should be targeted,and addresses the regulatory agencies,regulatory platforms,and consumer protection.There are suggestions for improving the system. |
