| According to the provisions of article 42 and the third paragraph of article 53 of our state’s civil servant law,it is banned that the civil servant earns money by doing part-time job.In recent years,even though the government has issued documents several times to prohibit civil servant from doing part-time job,actually the phenomenon is still widespread.Regardless of the government’s prohibition,some civil servants seek benefit by doing part-time job without permission,which is condemned strongly by the massive and may lead to corruption.Therefore,it is urgent to solve the problem of civil servant doing part-time job effectively.This article has targeted civil servant part-time job research,combined with specific cases.Based on sorting out the related formal domestic documents thoroughly and referring to the related foreign laws and regulations,the paper focuses on analyzing the reason why the civil servant does part-time job,and the harm caused by civil servant doing part-time job,and the legal problems of civil servant doing part-time job.The paper also probes legal approach to solve the problem of civil servant doing part-time job with practice and is dedicated to promoting the healthy development of civil service.Based on the present situation of our country and the civil service,the first chapter analyses the reason why the civil servant does part-time job,and the real harm caused by the civil servant doing part-time job,through several concrete cases theoretically.The second chapter focuses on the thinking of legal problems under the circumstance that the civil servants continue doing part-time job in spite of the government’s repeated prohibitions,and analyses the defects of the current laws on civil servant doing part-time job at the legislative level and the existing problems of the regulations and the supervision mechanism at the policy level.On the basis of examining the related laws on civil servant doing part-time job in England and France,the third chapter compares our country’s legal provisions and comes up with advice on our country’s legislative system for the fourth chapter,and strictly differentiates the types of civil servant doing part-time job,and specifies the range and conditions on banning civil servant doing part-time job,and establishes the supervisory mechanism on restricting civil servant from doing part-time job,which puts the civil servant doing part-time job under strict supervision of the law. |
