The Research Of Periodic Law Enforcement

With the development of society,social public affairs have undergone a trend from unity to speciality and complexity,which makes it harder for law enforcement agencies to deal with public affairs and has a huge impact on the employment of executive law enforcement.Under such a condition,law enforcement agencies find themselves in a dilemma of limited law enforcement resources and increasing demand of social law enforcement,therefore it is urgent for law enforcement agencies to choose a flexible law enforcement approach,that is,periodic law enforcement.Periodic law enforcement starts with the implementation of such periodic timing as law enforcement day,law enforcement week,and law enforcement month and has the characteristic of periodicity,regularity,non-movement,and non-induction.It differentiates itself from the institutionalized law enforcement routine.Periodic law enforcement takes the fulfillment of social public interests as priority and conducts regular and periodic law enforcement mode in accordance with law enforcement period so that the dilemma of the shortage of law enforcement resources and the increasing demand of law enforcement employment can be fixed.Periodic law enforcement integrates different law enforcement resources and put them into executive law enforcement activities efficiently,which,in return,has positive influence on law enforcement employment and the promotion of executive law enforcement.Theoretically,periodic law enforcement bases on the theory of cooperative governance,which emphasizes multilateral participation in social governance and falls into such law enforcement mode within discretionary administration.Different from movement law enforcement and selective law enforcement,periodic law enforcement conforms to the principle of equality and the principle of reasonable administration,which guarantees legitimacy and rationality.Practically,periodic law enforcement agrees with national configuration of executive law enforcement,provides efficient mechanism for joint law enforcement campaigns by law enforcement bodies from different departments,compensates the lag of law,and overcomes the law enforcement dilemma in new law enforcement fields,which facilitates the development of executive law enforcement.Periodic law enforcement is a brand-new law enforcement method applied in many law enforcement fields and it is adopted based on current law enforcement environment rather than the preference of instrumentalism by law enforcement agencies.Periodic law enforcement is the product of such factors as legislation,executive law enforcement,the public's will of abiding law,the supervision of representative institution,the will of the authority,profit incentive,and mass media.Law enforcement officers choose periodic law enforcement mode by the influence of those seven factors,which jointly constitute those variables in executive law enforcement.According to the nature demarcation of function,positive variables among those seven variables are legislation,the innate factors of executive law enforcement,the public's will of abiding law,and the supervision of representational institution;intermediate variables of indeterminate functional effect are the will of the authority and mass media;negative variable of inhibiting effect is profit incentive.Although periodic law enforcement has such positive functions as the enhancement of administrative efficency,the promotion of law enforcement,the utilization of information superiority,it has some shortcomings:distinct preference of efficiency and instrumentalism and the fomentation of risk-taking mentality of law breaker,and those disadvantages hinder the establishment of law faith in the public.Without the regulation of periodic law enforcement,it would be reduced to be the unhealthy law enforcement mechanism,which would impact daily routine of law enforcement in society transformation period.Starting from the nature of variables in law enforcement factors,this paper analyzes the motivation of periodic law enforcement,which contributes to the promotion of positive variables,correctly guides neutral variables,and inhibites and controls the influence of negative variables.What is more,this article further deepens the theory of cooperative governance,discusses feasible supporting auxiliary mechanism so that periodic law enforcement can be regulated and be chosen as a transitional law enforcement,which accommodates with current law enforcement dilemma and conforms to law and regulation.
