Research On Selective Law Enforcement Of Illegal Building Demolition

In the recent ten years,there are many illegal constructions in China.Its existence seriously affects the city's planning and public interests.The governments pay more attention to the illegal construction of a strong remediation clean-up operations,strictly investigate and deal with the behavior of illegal construction,in order to maintain the order of urban planing and construction management,improve the quality of living environment,so that to achieve the goal“minus the growth of the stock of housing,zero growth”.But in the process of governance,with the help of excuses of social interests some law enforcement officers abuse power to protect some illegal constructions due to some private interests.The selective law enforcement of illegal constructions will not only damage the credibility of law inforcement agencies,so that to against the establishment of legal belief,but also harm the benefit of people and trigger social contradictions.So the governance on selective law enforcement of illegal construction has become a tough problem for government.This paper from three typical cases in the analysis of China's demolition of illegally built law enforcement by way of governance reasons and selective law enforcement about solvingthe problems in the illegal selective enforcement of illegal buildingUnder this background,this paper analyzes the causes of China's law enforcement caused by the illegal building in the selective law enforcement and research the treatment methods from the three typical cases.This paper is divided into four parts,introduction and three chapters.The introduction mainly discusses the reasons,research significance and research methods of the topic.The first and second chapters list three cases,which describe the demolition of illegal construction by law enforcement officers.And the causes of selective law enforcement are also obtained in the first two chapters.The main problems that be concluded from these cases:law enforcement imbalance between the implementation,the investigation and approval procedures are not standardized,the internal regulation of administrative law enforcement is incomplete,and some social incentives.The third chapter discusses the problem about governance on selective law enforcement of illegal construction deeply,and summarizes some treatment methods in order to standardizethe work of law enforcement,make the city planning and development well organized.The treatment methods as follows:balance the law enforcement between the implementation,regulate the investigation and approval procedures,prefect the internal regulation of administrative law enforcement strengthen the cultural construction of the rule and law,standardize law enforcement work.
