In this age of economic globalization,intellectual property and patent right protection play an increasingly important role in promoting the development of science,technology and the social economy and in encouraging international competition.Thus,much attention should be paid to patent disputes which may arise as a result of patent expiration or infringement.However,relevant research on how to tackle with the patent expiration does not sparkle fierce debate in China.This translation report is based on the judgment of Kimble et al.v.Marvel Entertainment,LLC,Successor to Marvel Enterprise,Inc.,(2015)decided by the United State Supreme Court,which discusses the issue over the royalty payment after a patent is expired and the legal principle of stare decisis.It may help to attract more public attention on patent right protection and therefore facilitating the innovation.Under the guiding principle of text typology theory proposed by Reiss(1997),the translator seeks to choose appropriate translation principles and determines the further strategies and methods.In this translation report,?ar?evi?'s legal equivalence principle and Du Jinbang's legal exchange principle are adopted to deal with the difficulties the translator runs into in both lexical and syntactic level.Lexically,common words with legal meanings and terms of art and highly formal words are discussed at some length;while syntactically,corresponding approaches are applied to long and complex sentences,passive voice and nominalization.The translation practice report consists of four parts.The first part describes the background and sets forth the significance and objectives of the translation task,with the introduction of the nature and features of the source text.The process description,which comprises the second part,presents the selection of parallel texts,translation principles and strategies,the arrangement of schedule and the management of quality control.The third part,as the principal part of this report,is a manifestation of how the translator solves the difficulties when rendering the source text.The fourth part serves as a concluding part and summarizes the findings,implications,limitations and suggestions.It is hoped that the target text and this report will provide translators dealing with similar judgments with a clear reference.
