This report is based on the translation of Part 734 and Part 764 of the Export Administration Regulations(EAR).The EAR,a law of the United States,regulates the export and reexport of the US-origin items,software and technology for the purposes of advancing U.S.national security,foreign policy,and economic objectives.It is under the EAR that Bureau of Industry and Security,Department of Commerce(BIS)imposed sanctions on Zhongxing Telecommunications Equipment Corporation Ltd.of China(ZTE)in 2017 and 2018.In this report,the author introduced the source text and described the challenges that the author has been confronted with in the translation practice,including the translation of legal terms,juxtaposed synonyms,legal citations,long sentences and definitions in law,to discuss the Chinese translation of Part 734 and Part 764 of the EAR.The translation is mainly based on the theory of “legal equivalence” proposed by Susan ?ar?evi?,and six basic principles put forward by Li Kexing and Zhang Xinhong,especially principles of accuracy and precision,consistency and identity,and professional language,which based on the theory of “legal equivalence”,are complied with during the translation practice.Guided by such a theory and such principles,the author used the translation method of spelling out the intended meaning for legal terms which have no equivalent in China’s legal system,and adopted respective translation and unified rendering for different kinds of juxtaposed synonyms.For the translation at syntactic level,the author focused on consistency.The author hopes that this translation report,on the one hand,can provide some suggestions on legal compliance for China’s enterprises when they import the US-origin items,software and technology.On the other hand,this translation report may have some implications for the legislation of Export Regulation Law of China.
