Since Rawls' A Theory of Justice was published in 1971,justice has become the core issue in western moral philosophy and politics.This topic not only inspired the relevant discussion in the Anglo-American academic circles,but also affected the European academic circles,and influenced the research direction of some scholars and even the school of thought.In view of the debate between liberals and communists on the issue of justice,Foster analyzes and evaluates the debate between the two in his book "Contexts of Justice".It is not advisable for liberalism to ignore concrete contexts and the tendency of communitarianism to pay too much attention to concrete contexts.It is an attempt to seek a combination of universalism and contextualism in order to realize a kind of just theory of universalism of contextualism.After "The Right to Justification",Foster gradually broke away from the constraints of the western mainstream discourse,such as liberalism and communitarianism,and began to think more from the perspective of the critical theory of Frankfurt School.He no longer simply evaluates the gains and losses of the mainstream theory of discourse justice in terms of concrete points of view and argumentation,but puts forward the justice theory of justification.From the origin of Forster's justice theory of justification,as the main content of the justice theory of justification,the questioning and response to the justice theory of justification,and the evaluation and contribution of the justice theory are discussed in this paper.First of all,this paper discusses the views and opinions of Rawls as representative liberalism and Sandel as representative communitarianism,and then discusses Forster's analysis of the dispute between the two,on the question of "what is right and what is good first".He believed that liberalism represented a tendency of contextualism,while communitarianism represented a tendency of universalism,and put forward a kind of universalism of contextualism,which laid a foundation for thelatter to put forward the principle of defence.Foster also put forward the principle of defence on this basis.Secondly,it expounds the justice theory of justification,mainly from the concept of justification and the four dimensions of justification.Forster's justification is based on universality and provides corresponding reasons for justification in four different ethical,legal,political,and moral contexts.Thirdly,Forster's justice theory of justification has been questioned by the "pure" procedural theory,which mainly includes the contradiction between universality and concreteness in justification,falling into the dilemma of Kant doctrine and the implicit setting of the right to justification in human rights and so on..Specially challenged and responded to the challenge to defend its justice theory of justification.Finally,this paper analyzes the evaluation of Forster's justice theory of justification and its contribution to the academic circles,mainly discusses the human rights view of turning to constructivism,and Forster replaces international justice and global justice with a kind of transnational justice.To solve the problem of justice beyond the limits of national norms.Studying Forster's justice theory of justification helps us understand the latest achievements and developments of Western justice theory,constantly enrich our theory of justice,and can better guide and promote the construction of social justice in practice in China.
