A Report On The Translation Of Society Of Holy Transfiguration V. Gregory (2012)

This report is based on the judgment of SOCIETY OF HOLY TRANSFIGURATION v.GREGORY(2012).The case involved here centers on the issue of copyright infringement of translations via internet.At present,China has witnessed widespread development of internet and entered a commercial era of translation.However,both issues of copyright infringement and copyright of translation itself have not drawn enough attention.And the selected judgment by the United States Court of Appeals for the First Circuit will contribute to our further comprehension of copyright infringement via internet and the copyright of translations and also offer some practical experience in dealing with familiar cases in China.In terms of the translation of the selected judgment,the author first determines the text type of the source text,according to the text typology theory for legal texts proposed by Susan Sarcevic.Then,based on various purposes of various text types and in pursuit of the principles of legal translation,the author endeavors to achieve legal equivalence in the translation.The analysis on difficulties of the translation covers three levels,namely lexicon,syntax,and style.At the lexical level,the author focuses on the legal synonyms,and terms.At syntactical level,the key points lie on the translations of nominalization,passive voice and long and complex sentences.At the stylisticic level,the author explores some translation of the vivid expressions reflecting the unique writing style of the judge.In sum,through translating the judgment,the author dose hope to offer some possible solutions to the common problems in judgment translation and also to draw more attention to copyright infringement via internet and the copyright of translations.
