The report is based on the text Authors,Users,and Pirates-Copyright Law and Subjectivity(excerpts)(Copyright Law),which is a doctoral dissertation on legal issues written by James Meese.However,his disciplinary background is in cultural studies and media and communications,James Meese needed to further his understanding of legal theory and philosophy.This doctoral dissertation would present a new approach to intellectual property,focusing on the relationship between authors,users,and pirates,and the core of his arguments is the concept of relational subjectivity,explored how relational subjectivity is supported or ignored in particular jurisdictions and specific cases.The purpose is to provide new ideas for the study of copyright law and to provide readers with legal knowledge of copyright protection.The source text of the report is an excerpt from the introduction and the first chapter.It mainly discusses the structure of the book and sees how the authors,users,and pirates emerged from a messy and incoherent process of legal clarification and classification across the eighteenth and nineteenth century.The guiding theory selected in this report is German Functionalist Translation Theory proposed by Katharina Reiss,Christiane Nord et al.And this report illustrates the application of Skopos rule,coherence rule and fidelity rule into the translation.This report first gives an brief introduction to the translation task,including task description,significance;then it introduces the translation process.Next,the history of German Functional Translation Theory is used in this translation practice.The fourth part is that the translator selects specific cases in the translation project to analyze the translation practice from lexical,syntactical,and textual translation,some translation strategies and techniques are used such as amplification,conversion,division to solve the difficulties.Finally,this report summarizes gains and limitations.
