An Analysis Of The Debt Guarantee Phenomenon In Qin And Han Dynasties

"Debt guarantee" is a kind of economic behavior that establishes the guarantee way of the third party's credit or the debtor's specific property,thus prompting the debtor to perform the debt to guarantee the realization of the creditor's claim.Although there was no such concept in the Qin and Han Dynasties,there have been a large number of guarantee methods and measures to guarantee the realization of creditor's rights and to prevent debt disputes,and these methods and measures are basically in line with the modern legal concept of the definition of debt security.This article sorts out the debt guarantees in Qin and Han Dynasties from the perspectives of the way of debt guarantees in Qin and Han Dynasties,the reasons for the development of debt guarantees,the characteristics and impacts of debt guarantees,in order to have a further understanding to the debt guarantee activities under the Qin and Han commodity economy and how the Qin and Han governments prevented debts.In addition to the research background and status quo,the introduction part mainly defines the concept of "guarantee" and discusses the development course of "guarantee" during the pre-Qin period.The first chapter "The way of debt guarantee in the Qin and Han Dynasties" is the main content of this article.Based on the records of the handed down documents and unearthed materials,the guarantee methods of the Qin and Han Dynasties were elaborated from four aspects: personal guarantee,labor guarantee,property guarantee and guarantee guarantee.The second chapter from four aspects to discuss the economic,political,and social conditions which the conditions for the development of the debt guarantee of Qin and Han Dynasties.The four aspects are the development of the commodity economy of the Qin and Han Dynasties,the country's recognition and intervention of creditor's rights,the normalization of the contract,and the joint and several liability in the rural system.The last chapter analyzes its characteristics and influences.Qin and Han debt guarantees have had an important impact in preventing debt disputes,promoting social stability and economic development,and laying foundations for future debt guarantees.
