Research On System Of Confucian Classics’ Doctor In Han Dynasty

Setting up the Wu Jing(the five Confucian classics)Doctor in Han Dynasty is the hinge in the development of Jing(Confucian classics)Doctor System,and also one of the flags of the prosperity of Confucianism.The reasons for Emperor Wu of Han setting doctors only for five Confucian classics except Yue,in addition to some objective causes,might be related to the ideology of Wu Xing which was prevailing then.After setting Wu Jing Doctor,recruiting disciples for doctors made the Shifa of Confucianism(the classics which hand down in a direct line from Confucius)to fan out and the Jiafa(the classics which evolve from Confucius’ classics)to spring up,and changed the state of restricting the five classics to Shifa in official education.The appearance of Old Text Confucianism broke the tradition of New Text Confucianism,also changed the subjects of Jing Doctor.The change of selection and treatment for Jing Doctor indicates that the status of Jing Doctor rose up in western Han Dynasty,but fell down again in eastern Han Dynasty,which also can be indicated by Jing Doctors’ function of discussing state affairs being weakened in eastern Han Dynasty.Taking office for Jing Doctor is closely associated with specific classics which are specified by government.The nature of Doctor is erudite and informed,which require doctors shall learn other classics,including Shifa and Jiafa.These differentiate "learning"and“using”of Jing Doctors,and such differences influenced the official career of Jing Doctors.In the several functions of Jing Doctors,discussing crime is very important.Jing Doctors participate in discussion of the amendments of law and the judgements of serious cases.“Adducing Quotations of Classics in Trial”is one of important trial modes in Han Dynasty.This thesis would analyze some trial by Dong Zhongshu and others in western Dynasty,discuss subjectivism and objectivism of“Adducing Quotations of Classics in Trial”.And furtherly dig the game between law and Confucian classics argumentations,and between Confucian classics argumentations and monarchical power,then explore trajectory of law compromise to Confucian classics argumentations and argumentations compromise to monarchical power.Through this,we can appraise the effect of Jing Doctor system.
