Research On The Responsibility Ethics In Doctor-patient Disputes

Disputes between doctors and patients are prominent problems that hinder the construction of a harmonious doctor-patient relationship,and are also key factors that restrict the healthy development of medical and health undertakings.It is not difficult to find through analyzing the cases of doctor-patient disputes,including the responsibilities of medical institutions and doctors,as well as the reasons of patients and their families,the reasons of imperfect system and mechanism and inadequate government supervision and management,and the factors of exaggerated publicity and out-of-context in the media.On the surface,doctor-patient disputes are individual problems caused by lack of trust or improper handling of relationships between individual medical institutions or medical personnel and individual patients or their families.However,from a deep analysis,the doctor-patient dispute reflects the weakening of responsibilities of government functional departments,medical institutions,medical personnel,patients and their families,and the media.Through literature research,this paper sorts out the relevant literature on the issue of doctor-patient disputes at home and abroad,defines the core concepts and establishes the theoretical basis of responsibility ethics,and proposes that the research of responsibility ethics in doctor-patient disputes should take the other's thinking as the logical starting point,the bottom line thinking as the moral bottom line,the situation thinking as the thinking field,and the theory guiding the practice.After analyzing the current situation of some responsible subjects in doctor-patient disputes,it is found that there are mainly the following situations,which are reflected in the lack of ethical spirit of responsibility and insufficient moral self-discipline of some medical personnel.Some patients and their families are not accurate enough in judging the relationship between medical behaviors and results,and the relationship between their rights and obligations is not reasonable enough.The management of some medical institutions is not standardized enough and the performance of services is not humanized enough.The main responsibility of the government is not in place,and the supervision responsibility is not in place.The media report is unbalanced in fairness and the supervisory function is alienated.Through systematic analysis,from the five levels of medical personnel,affected parties,medical institutions,government and media,the author applies the theory of responsibility ethics to make a profound analysis of the causes of responsibility behind the doctor-patient disputes,which is mainly attributed to the following five aspects: the dilution of responsibility ethics of some medical personnel due to one-sided emphasis on technical responsibility,alienation of the concept of justice and benefit,and ectopic professional ethics;The lack of rational knowledge of medical technology,the unequal mastery of medical information between the affected party and medical personnel,and the lack of trust in the fulfillment of responsibilities by medical personnel have led the affected party to neglect its own responsibilities.The government mechanism construction responsibility caused by imperfect medical security mechanism and imbalance of medical marketization mechanism needs to be improved.Hospital management responsibilities caused by imperfect information disclosure system and poor doctor-patient coordination channels need to be strengthened.The role of media responsibility needs to be improved.Finally,this paper proposes to build a harmonious doctor-patient relationship under the responsibility ethics: to strengthen the main responsibilities of both doctors and patients,that is,to strengthen the main responsibilities of medical personnel,patients and their families;To create an ethical situation for medical institutions,clarify the scope of responsibilities of medical institutions,standardize the operation and management of medical institutions,and optimize the service functions of medical institutions;To speed up the construction of responsible government,improve the construction of legal mechanism,improve the ability of the government to fulfill its responsibilities,and strengthen the supervision of government responsibilities;Strengthen the self-discipline of the media,adhere to the objectivity of media publicity,the fairness of media supervision,the public welfare of media services,and promote the construction of a harmonious doctor-patient relationship.
