In the process of urbanization,a large amount of high-quality cultivated land has been expropriated and transformed into urban construction,meanwhile,fierce land acquisition contradictions were triggered.It is inevitable to formulate a scientific and reasonable compensation standard for land requisition.However,the current compensation standard for land acquisition has some problems such as compensation content defect,low compensation amount and fuzzy compensation,therefore it needs to be further improved.Besides,the promotion and implementation of the innovative property right system,the division of the three rights of rural land,puts forward new requirements for the further improvement of the standard of compensation for land expropriation.The academic circle has done a lot of research on the compensation of land acquisition,but there are still some exploration spaces in the construction of the compensation standard for land acquisition.In this paper,the evolution of the land requisition compensation standard system is first combed,then the problems and causes of the current land acquisition compensation standard are analyzed.The theory of sustainable development and the theory of marginal utility value are used to study the value of the cultivated land from the function of the cultivated land,then the loss of the cultivated land value caused by land acquisition is analyzed,and the compensation of the cultivated land value by the method of income reduction,the cost method and the equivalent factor value method is adopted.This paper discusses the compensation distribution of the cultivated land value from the view of the agricultural land "Three Rights Division",and constructs the land acquisition compensation standard for the three-right main body of the agricultural land,and chooses Hefei to carry out the empirical analysis.Fortunately,on the premise of rigorous logical analysis,we come to the following conclusions.(1)The cultivated land has three primary functions of economy,society and ecology,so that the cultivated land has economic,social and ecological value.The economic value of the cultivated land includes the value of the net contribution of the cultivated land,the value of the structure and the value of the value of the asset.The ecological value of cultivated land includes climate regulation,environmental purification,carbon and oxygen balance,water and soil conservation,biological diversity and landscape cultural value.(2)The land requisition compensation standard based on the comprehensive value of the cultivated land is not 100% compensation for the loss of the cultivated land value.in which the value of food security is shared by the society and this part of the value compensation has been reflected in the agricultural related subsidies in the past years,so it is not included in the compensation category of the land acquisition;the ecological value of the cultivated land is the same as that of the society,and the cost is taken into account for the maintenance of the farmland ecosystem,Therefore,70% of the ecological value is included in the compensation category of land acquisition,and 40% of the value of the asset value-added value belongs to the land requisition compensation area,so that 40% of the value of the ecological value is included in the land acquisition compensation category,and the net contribution value and the structure value of the cultivated land,The value of old-age security and the value of spiritual comfort are included in the compensation category of land acquisition in full.(3)Based on the three-power split and the fact that the farmland is flowing,the compensation of the value of the value-added value and the compensation of the ecological value of the main body of the land ownership in the land acquisition compensation is obtained;and the main body of the operating right obtains the partial economic value compensation,The compensation for the value of the structure and the value of the net contribution of the part of the cultivated land(the specific proportion is determined according to the duration of the contracted operation contract),in which the premise of the compensation of the structure value to the main body of the operating right is that it is the actual input party of the structure;the main body of the contracting authority obtains the compensation of the value of the structure,Partial asset value-added value compensation,total social value compensation,partial ecological value compensation and partial net contribution value compensation,in which the premise of the structure value compensation to the contracting right main body is that it is the actual input party of the structure.(4)The standard of compensation for the syndrome in Hefei is 11.85 million yuan/ mu,which is 2.2 times the current standard of Hefei.The economic value of the cultivated land is RMB 8.17 million Yuan/ mu,the social value is RMB 0.07 million Yuan/ mu,and the ecological value is RMB 3.61 million Yuan/ mu,accounting for 68.9%,0.6% and 30.5% respectively.According to the ownership,contracting right and operating right,the land acquisition and compensation standard is 2.33 million yuan/ mu,9.16 million yuan/ mu and 0.36 million yuan/ mu.The result shows that the land requisition compensation standard based on the comprehensive value of the cultivated land helps to protect the interests of the local people,and is in accordance with the reform value orientation of the continuous improvement of the living standard of the farmers.
