Empirical Study On The Law & Policy Of Lift Installation In Existing Residential Building

The aging trend of China's population is severe,of which the proportion of elderly population has exceeded the "double standards" of international society,and the "wave of silver" sweeping across the mainland of China showing distinct Chinese characteristics,which have brought tremendous challenges to China's economic development and social management.In order to cope with the social problems caused by the aging population,the Chinese government has brought the work of aging into the major strategic plan of the country.One of the important measures is to carry out Elderly Housing Project actively,advancing the renovation of old residential building and encouraging the installation of lift in existing residence.In the implementation of lift installation in existing residential building,due to the lack of clearly legal support and the difference of policy guidelines,the public opinions are often divergent and the contradictions sometimes become acutely.Hence,the local regulatory authorities have to handle with the complains and disputes,and the work of lift installation in existing residential building is difficult to be advanced or sometimes is even forced to stop.Based on the abovementioned reasons,there is an urgent need to make a comprehensively review on the policy provisions,implementation situation and focuses of dispute.It is also necessary to explore,improve and perfect the laws,regulations and rules of the city renewal.Firstly,based on the severe situation of aging trend of China's population,the thesis took Xiamen City as an example to discuss the construction background of existing houses,the characteristics of customers who bought the house with elevator,the number of lift installation in existing residential building,and the practical exploration of advancing the lift installation in existing residential buildings,which illustrates the urgency of lift installation of the existing houses and the importance of improving relevant laws and policies to supplement the defects of people's livelihood.Then,the limitations of relevant legal provisions and policy guidance in the practice of lift installation in existing residential building,and the litigation cases and their characteristics arose from the policy implementation process in China are analyzed in detail.After that,the main focuses of dispute in the practice of lift installation in existing residential building in China are summarized.Finally,learning from the successful experience of Lift Upgrading Programme of HDB house in Singapore,the thesis puts forward some suggestions on the improvement of law and policy of lift installation of exiting residential buildings in our country,including clarifying the project nature of lift installation,determining the voting way by legislation,identifying the standard of valid voting power,expanding the scope of solicitation,improving the policies and systems to guarantee supply,perfecting the supporting measures,and so on.
