With the rapid advancement of urbanization in China,the recession of the old urban areas has become increasingly prominent,and the demand for the development of urban stocks is increasing,making urban renewal an increasingly important part of urban development.Although the ownership of urban land is owned by the state,the actual right to use urban land has been distributed to various property right owners.In the process of urban renewal,it will inevitably involve the adjustment of land use rights and interests of the original property owner.How to coordinate the stakeholders' rights and interests is an important issue to ensure the orderly advancement of urban renewal affairs.Under the previous urban renewal system,the dual-agent participation model led by the government and market participation has led to many problems such as excessive development intensity,difficulty in demolition and relocation,and inner city gentrification.The author believes that these problems are related to the urban-renewal model led by the bureau:First,the imperfect motive of the dualistic subject leads to the rent-seeking of the local government and the loss of the public interest;Second,the unbalanced power of the binary subject leads to the expansion of government power and the cross-border market Intervention;Finally,the absence of roles in the dualistic model leads to imbalances in the distribution of benefits and the failure of public participation.Using the theory of public choice,the theory of power restriction and the theory of public participation ladder to analyze the binary dominance model of urban renewal,we find that the root of the above problems lies in the failure of the dualist subject,the failure of the power constraint,and the failure of the participation of the third sector.The solution lies in the introduction of the third sector in the urban renewal process,the empowerment of the third sector,and the third sector organization as the main body of public participation.Through observing the practice of participation of the third sector at home and abroadin urban renewal,it was found that in the Taiwan region of China,the third sector organization participated in policy formulation,the spirit of updating the decree,assisting disadvantaged groups,and leading community building and providing education and training.Urban regeneration has played an active role.In the United Kingdom,the partnership formed by the representatives of the third sector organizations,government departments,and market players has developed into a mature renewal system that plays a leading role.In China's mainland,despite the fact that the third sector has not yet formed a specific model for urban renewal,there have been attempts to introduce the third sector to participate in urban renewal during the phases of house demolition and community planning.Various practices show that the participation of the third sector in urban renewal can play an active and effective role.Based on the analysis of the theoretical level and the practical level,the author believes that the solution to the problem of urban renewal under the dualistic leadership is to introduce the third sector to participate in urban renewal.In combination with the basic institutional arrangements in the mainland of China,the following strategies are proposed:(1)Organizational structure: The focus is on updating the rights of the main body.First of all,adjust the institutions that the urban renewal leads,and add the urban renewal committee at the city and district planning and management departments.Secondly,the city renews the partnership and is led by the Urban Renewal Committee.It forms a partnership with the third sector organization,the public,and the market to renew the partnership and negotiate arrangements for the urban renewal process.Finally,determine the participation roles of different types of third sector organizations.(2)Procedural Arrangement: According to the type of update,local development and actual project needs,the procedures for the third sector to intervene in urban renewal are divided into independent project type,phase assistance type,and decision core type.Develop specific intervention procedures for different intervention types.(3)Implementation of safeguards: First,improve the legislation for the third sectorand,on the one hand,improve the relevant laws and regulations for the third sector;on the other hand,in the urban and rural planning laws and urban renewal statutory documents,the third sector's participation in the main body is stipulated..Secondly,improve the appeal mechanisms for the third sector to participate in urban renewal,including the third sector to organize complaints about the planning results and the public's complaints regarding the participation behavior of the third sector.
