The Legal System Of Ecological Environment Restoration Research

China's economic development is rapid,social progress is huge,people's living standards have been gradually improved,but in the process of social and economic development,from time to time,natural resources have been destroyed,ecological environment pollution,social public interests have been infringed.Xi stressed that "green waters and green mountains are like mountains of gold and silver," a vivid illustration of the importance of the environment and the nature's revenge on human beings in the current2019-ncov.The function and value of the ecological environment and the environmental public interest are protected by the Environmental Public Interest Litigation,but the tort liability such as compensation for damage and restoration of the original state does not meet the need for the relief of environmental damage,therefore,new forms of liability should be made up for the shortcomings of these tort liability.Therefore,in order to supplement the liability system of Environmental Civil Public Interest Litigation,the legal system of ecological environment restoration has emerged.This paper is aimed at the research on the overview of ecological environment restoration,the present situation and problems of China's legal system of ecological environment restoration,the review and enlightenment of the legal system of ecological environment restoration abroad,and the suggestions for the perfection of China's law of ecological environment restoration,it mainly includes: The first part is the overview of the legal system of ecological environment restoration.Starting from the connotation of ecological environment restoration,this paper analyzes the origin of the legal system of ecological environment restoration,understands the evolution of the legal system of ecological environment restoration in China,and clarifies the necessity and feasibility of implementing the legal system of ecological environment restoration,therefore,it can perfect our country's legal system of ecological environment restoration.The second part is the status quo and problems of the legal system of ecological environment restoration in China.This paper presents the present situation of the legal system of the ecological environment restoration in China from the aspects of legislation and judicial practice,points out the problems existing in the legal system of the ecological environment restoration in China,and puts forward some suggestions for the improvement of the legal system.The third part is the review and enlightenment of foreign legal system of ecological environment restoration.Through the investigation,analysis and comparison of the legal system of ecological environment restoration in America,Germany and Australia,this paper provides the reference value for the construction of the legal system of ecological environment restoration in China.The fourth part is our country ecological environment restoration law consummation suggestion.On the basis of the existing research results and the successful experience of developed countries,the paper puts forward some suggestions on the improvement of China's legal system of ecological environment restoration.Mainly from the legislation,improve the judicial process,clear the ecological environment restoration fund,strengthen supervision and so on.
