Research On Wetland Protection Legislation In China

As a complex,independent,and special ecosystem on the earth's surface,wetlands have irreplaceable ecological,social,and economic values,and are of great significance to the survival and development of human beings.China is a large wetland country with diverse types,large areas,and wide distribution.Wetland protection is one of the important contents of ecological civilization construction in China.However,the imperfect wetland protection laws and regulations are in stark contrast with the urgent wetland protection needs,which leads to the lack of comprehensive systems and legislative guarantees for wetland protection,which has destroyed the diversity of wetland resources and the integrity of the wetland environment.Wetland protection is facing serious problems.Studying the legislation of wetland protection in China will help provide important guarantees for the construction of ecological civilization."Establish the good law in the world,then the world will be peaceful;establish the good law in a country,then the country will be stable." The good law needs to be in line with the national conditions,be people-oriented,and help solve the fundamental problems of national development.This article studied the legislation on wetland protection in China,and summarized the departmental regulations,local regulations,and local government regulations related to wetland protection that have been promulgated since China joined the Convention on Wetlands of International Importance Especially as Waterfowl Habitat in 1992.More than 60 regulations are compared and sorted out,finding commonalities and identifying inadequacies.Based on the full summary of the current wetland protection legislation in China,we will draw on relevant experience of wetland protection legislation outside the region,and propose a feasible path for improving the wetland protection legislation system,main content,key systems,etc.In addition to the introduction and conclusion,this paper will be divided into four parts: the first part is an overview of wetland protection,combined with the "Wetland Convention",the relevant regulations of other countries and China,explain the definition of wetland concept,the importance of wetland protection and thenecessity of wetland protection legislation,and the nature of wetland protection legislation is analyzed.The second part is the analysis of the wetland protection legislation present situation,through combing the development of our national and local wetland protection legislation and the present situation,analyzing and comparing the current wetland protection legislation of the main contents and key system,summarized the current problem of wetland protection legislation in our country.The problem is reflected in three aspects: incomplete legislative system,incomplete main content,and imperfect key system,and every aspects of the specific problems and causes are analyzed.The third part is the reference to the legislation of wetland protection outside the region.It respectively summarizes the experience of wetlands convention,the United States,Australia,the United Kingdom and other representative countries in wetland legislation,and draws on their beneficial specific systems and management systems.The fourth part is the suggestions on improving the legislation of wetland protection in China.Focusing on the above-mentioned problems,puts forward targeted suggestions on straightening out the legislative system,improving the main content and improving the key system.
