Study On The Compulsory Liability Insurance System Of Environmental Pollution In China Under The Pilot Analysis

In recent years,China has entered a period of high incidence of environmental emergencies.Behind the rapid economic growth is the heavy cost of sacrificing the environment.Although as early as 2007,the authoritative department issued the guiding opinions on environmental liability insurance work,which formally carried out the pilot work in some key industries and special areas of China's environmental liability insurance,to some extent,this is the prototype of China's environmental pollution liability insurance system.However,under the current system and normative system in China,the system has been in the dilemma of insurance difficulty,responsibility difficulty and compensation difficulty.Therefore,in the guidance on carrying out the pilot work of compulsory environmental liability insurance in 2013 and the management measures for environmental pollution compulsory liability insurance(Draft)reviewed and adopted in 2018,China has tried to adopt the policy in some areas.The way of compulsory insurance is the rudiment of the compulsory liability insurance system of environmental pollution.This bold attempt is a breakthrough innovation to deal with the current environmental risks.This paper will first give a brief overview of the concept of environmental pollution basis,and briefly describe its relationship with the existing environmental pollution liability insurance system in China.Secondly,combing the current system framework and normative system,through the analysis of the current situation of the application of the system in the pilot area,to find the problems in the process of implementing the current system,so as to further explore the legal problems that may be hidden in the process of building the system,and explore the root causes and influencing factors of the problems.Then through combing the foreign system and legal norms,and learning from its successful experience.Finally,the paper puts forward some suggestions on the development path of the system,such as improving legislation,supporting system design,strengthening supervision and so on.
