Research On Compulsory Environmental Pollution Liability Insurance In China

At present,China is in a period of rapid economic development.Environmental pollution and ecological damage is increasing,especially environmental pollution incidents,which result so many significant casualties and property damage.The corporate of China has not forceful social responsibility consciousness.Environmental risk management and awareness of prevention is weak,so there is a huge amount of cost on the governance of environmental pollution.Many companies can not guarantee their own business,or even bankruptcy,so that the victim can not get timely relief,which increases the burden of government social management,increases the emergence of social contradictions.Therefore,the national policy began to vigorously promote the compulsory environmental pollution liability insurance system,with full insurance tools to diversify the risk of environmental pollution,strengthen victim damage compensation and environmental governance.At present,China's compulsory environmental pollution liability insurance system still depends on the policy advocacy,the pilot effect is not ideal,there is a lack of legal basis,environmental tort liability is imperfect,the imperfect insurance supporting mechanism results in poor operation,which restrict the functions and advantages of the compulsory environmental pollution liability insurance system.The article focuses on the empirical analysis that including the domestic and foreign compulsory environmental pollution liability insurance system of legislation,and specific system content.This paper puts forward some suggestions on the hot issues such as the progressive solution of environmental pollution,mental damage compensation,ecological damage compensation,enterprise environmental risk assessment and monitoring system.In this paper,there are many suggestions to endure the compulsory environmental pollution liability insurance to play a great role,such as insurance coverage,insurance agencies,claims,trying to provide a clear basis just as administrative regulation.On this basis,we should put forward the insurance supporting mechanism,the government policy recommendations,to promote that the system is truly "landed".
