Research On The Legislation Of Exhaust Pollution Prevention For Non-road Mobile Machinery

Exhaust pollutants from non-road mobile machinery,as an important part of the air pollution source,have an increasing negative impact on our daily life and work.However,the progress of our country's legislative research work is still very slow and is in the exploration stage.With the continuous improvement of motor vehicle emission standards and oil quality standards,pollution prevention and control of non-road mobile machinery has gradually entered the field of vision of theory and practice.At present,at the central level,China's legislation on the prevention and control of exhaust pollution from non-road mobile machinery is scattered in laws such as the“ Air Pollution Prevention Law ” and the “ Environmental Protection Tax Law”;at the local level,Xi'an,Chengdu,Foshan and other places have issued laws and regulations There are 13 local special legislations for the prevention and control of exhaust pollution from non-road mobile machinery.By exploring China's current legislation on the prevention and control of exhaust pollution from non-road mobile machinery,it is found that they provide specific systems for pollution prevention,such as record registration,emission standards,delineation of prohibited areas,and the standardized use of new energy fuels,as well as the division of supervisory responsibilities for supervisors and The legal responsibility of each subject has guided the current exhaust pollution prevention work.However,through the analysis of the current legislative situation inChina,we found many problems in the prevention and control of exhaust pollution of non-road mobile machinery.There are no administrative regulations for the prevention and control of exhaust pollution of non-road mobile machinery.The regulations for the prevention and control of exhaust pollution of road mobile machinery are not perfect,the legal system is not meticulous,and the legal punishment is not strong enough.In order to solve these problems and promote the process of pollution prevention and control,it should be based on the existing legislation on the prevention and control of exhaust pollution of non-road mobile machinery,and on the basis of drawing on the experience of foreign excellent prevention and control legislation,put forward legislative proposals.First,it is recommended to amend and improve the provisions of the Air Pollution Control Law for non-road mobile machinery exhaust pollution;then,it is recommended that the State Council formulate the "Regulations for the Prevention and Control of Non-road Mobile Machinery Exhaust Pollution" to provide uniformity for pollution prevention theory and practice.Comprehensive guidance to form a complete non-road mobile machinery exhaust pollution prevention system.
