Research On The Legal Mechanism Of Ecological Compensation In Yangtze River Basin

Since the Eighteenth National Congress of the Communist Party of China,with the acceleration of the construction of socialist rule of law,the CPC Central Committee has put forward a new strategic plan for the development of the economic belt in the Yangtze River Basin.It is urgent to establish a legal mechanism for ecological compensation in the Yangtze River Basin.Generally speaking,there are still many deficiencies in the ecological compensation mechanism of the Yangtze River Basin.The main reasons are as follows: Firstly,the traditional watershed ecological compensation theory has a single value goal and lacks the basis of legal argumentation;secondly,the relevant legal system of ecological compensation is not complete;thirdly,the vertical ecological compensation mechanism is not perfect;fourthly,the horizontal ecological protection compensation mechanism is not perfect;fifthly,the market-oriented diversified ecological compensation mechanism is lacking.This paper analyses the practical dilemma of traditional river basin ecological compensation theory in solving the problem of ecological compensation in the Yangtze River Basin,and evaluates the legislation,practice mode and deficiency of ecological compensation in the Yangtze River Basin.At the same time,drawing on the advanced experience of foreign watershed ecological compensation,this paper intends to solve the key problem of how to improve the legal mechanism of ecological compensation in the Yangtze River basin.The Nineteenth National Congress of the Communist Party of China pushed the construction of ecological civilization and green development to a new historical height,opened a great new journey of building socialist modernization,and described a grand blueprint for building a beautiful China.In the new era,China’s new historical orientation for development is clearly defined and new historical missions are undertaken.The ecological environment protection of the Yangtze River Basin will face new situation and meet new tasks in the new era.Therefore,we should further enrich the theoretical basis of ecological compensation in the Yangtze River Basin,and continue to improve the legal mechanism of ecological compensation in the Yangtze River Basin.Guided by Xi Jinping Thought on Socialism withChinese Characteristics for a New Era,we should strengthen the legislation on ecological compensation in the Yangtze River Basin from the national and local levels.Perfecting the vertical ecological compensation mechanism in the Yangtze River Basin,promoting the horizontal ecological compensation mechanism in the Yangtze River Basin,establishing an incentive mechanism for the ecological compensation market in the Yangtze River Basin,improving the multi-input mechanism for ecological compensation in the Yangtze River Basin and perfecting other relevant mechanisms for ecological compensation in the Yangtze River Basin.Thereby strengthening the top-level design of environmental law in the Yangtze River Basin and improve the long-term mechanism of ecological compensation.
