| Under the present era background,the global environment problem increasingly serious,river basin ecological environmental problems also become increasingly serious,restrict the economic and social development of river upstream and downstream areas continuously.However,the characteristics of the river basin across different regions for the management of river basin ecological environment has brought the huge challenge.In order to restore river basin ecosystem service function,solving the problem of river basin ecological environment,we must improve and perfect the legal system of river basin ecological compensation of China.River basin ecological compensation is,for the realization of the watershed ecosystem services between offer and enjoy the process of social justice,through the effective way that combined with the economic means and administrative measures,beneficiaries of river basin ecosystem services on specific ecological compensation fund,and put the compensation for the provider of river basin ecological service legal system.However,The development of river basin ecological compensation system,still exist some reality problem such as imperfect legal system,lack of unified legislation principle,unreasonable compensation standard,compensation mode single,the existence of these problems seriously affect the development of river basin ecological compensation system in China.In order to break through the bottleneck,combined with experience of river basin ecological compensation at our country and abroad,This paper tries to give a perfect river basin ecological compensation legislation,clear the basic principles of river basin ecological compensation,the determination of river basin ecological compensation standard,establish a diversified measures of river basin ecological compensation mode,etc.Thus for the perfection of the legal system of compensation for watershed ecology in China and help on the solution of the river basin ecological environment problems. |
