Study On The Legal System Of Ecological Construction Land Protection

China is a big country with a large population but limited resources,The rapid development is difficult to sustain if it continues to consume resources and destroy the ecological environment.However,with the rapid economic development,many land with outstanding ecological functions have been abused,and the ecological functions of land havebeen seriously degraded.The issue of land ecological security urges human beings to pay attention to how to protect the land ecological system.In this context,using legal means to protect the ecological construction land can make that give full play to the ecological service function.Therefore,it advocates building the protection of ecological construction land legal system,papers from the following five aspects:The first part is the introduction.This part starts with the research status at home and abroad,introduces the purpose and significance of the system,and makes necessary theoretical preparations for the construction of ecological construction land protection legal system inChina.The second part is an overview of ecological construction land,under the perspective of law,define the concept of ecological construction land,compares and analyses the relations of ecological construction land to agricultural land and unused land,after that divides the ecological construction land,defines the scope of ecological construction land.The third part is the problems in the protection of ecological construction land in China,which are manifested in the following aspects: Ecological construction land in land use conflict is easily occupied;the land classification system is unscientific;the land expropriation system causes a largenumber of ecological construction land to be converted to construction land;and the legal responsibility system for the protection of ecological construction land is imperfect.The fourth part is the necessity and feasibility of setting up a legal system for the protection of ecological construction land.The legal system for the protection of ecological construction land is constructed to guarantee the national ecological security which under the situation of ecological construction land in distress,based on the support of the concept of sustainable development,the guidance of the concept of ecological civilization and the help of science.The fifth part is the concrete conception of the legal system for the protection of ecological construction land.The basic contents include: perfecting the land classification system in China;implementing the graded protection of ecological construction land;Strengthening the management of ecological construction land based on the requirements of ecosystemmanagement;and constructing the legal responsibility system for the protection of ecological construction land.Using the legal means to protect ecological construction land,playing its ecological function to protect the ecological security of our countiy,we are really determined to build theecological environment and create a good living environment for the people.
