The Research On Wet Land Resource Protection Law System In China

Wet land is a very special ecology system which is composed of various factors such as water , soil , living things , and it is also a nature resource .wet land not only provide hunman beings land , agriculture product, industrial raw material, but it has the value of tour going sightseeing and science study. Besides, wet land can protect ecology ,make sure it is safe. For example ,wet land can store water, purify water, regulate climate, defend biodiversity and so on.wet land in China area is extensive , the type is various , distribution is vast. It provide agriculture product, industrial raw material, defend our country and even the whole world regional ecological environment, protect the special wet land animal and plant species in our country, relieve flood and waterlogging disaster which happen frequently . During the past several years ,with the rapide rise of population size and the population density promptness , the needing amounts of wet land is enhancing unceasingly , the discharge of industry development increase and the functional threat to wet land is aggravating. Despite of our country government already has protected wet land in the way of propaganda and education and , enacted some wet land protection law clause in the crrent law and regulation system , the wet land area still falls off rapidly , the function faces a serious destruction.Early In 1971, the international community has already worked out a global wet land protection convention -----"wet land convention " . At present , most country which have fruitful resource of wet land have established the wetland protection legal system. Abuseing wet land excessively, contaminating aggravating and the situation that wet land is not considered as a single-handed resource to protect in law exist in china. China has built a legal system of wet land protection now ,but it is not very perfect . For example , lack of specialized wet land protection law , especially value , basic principle and law system. The main body of this paper can be divided three parts as the following . The first part is a summarize of wet land resource . The second part has analyzed some theory base about wet land protection , especially the sustainable development environment theory which is a new viewpoint. Part III has introduced the experience and enlightenment wet land protection legal system abroad . Part IV has introduced our country current situation about protection of wetland . The fifth part is most important .This part suggestes that our country should constitute specialized wet land protection law . and it should take the sustainable development environment ethics as legislation purpose .The relevance legislation principle should be the mainline of the law . Morever , some concrete system is necessary.
