Study On The Republic Of China's Mourning Apparel Act Under The Concept Of Equality

Stand on the historical background that the Republic of China overthrew the feudal hierarchy that had lasted for two thousand years and implemented constitutionalism and law,this paper adopts the method of literature research and comparative analysis to study the mourning apparel acts issued during the Republic of China.This paper studies and analyzes the legislative spirit and process of promulgation.The provisional constitution of the Republic of China put forward the strategy of ruling the country by law,which reflected to the clothing level that is to stipulate the national dress by the mourning apparel act.After many amendments and discussions in the senate,it can be seen that the enactment of the mourning apparel act is not a hasty behavior.This paper sorts out and studies various clothing laws issued in the period of the Republic of China,including three basic clothing laws,professional uniform laws,as well as bans on woman's foot binding,man's braid and fancy dress.Among them,the basic law of mourning apparel is the 1912 ‘s mourning apparel act,1929 ‘s mourning apparel regulation and 1939 ‘s amendment bill of mourning apparel.The professional uniform act covers judicial,diplomatic,transportation,local administration,and military and police aspects.In terms of putting feet,cutting pigtails and prohibiting fancy dress on the ground,the government and local governments have promulgated various decrees and ordinances to prohibit the combination.This article takes the modern newspaper as the medium,counts and analyzes promulgation,the reprint and the implementation condition of each mourning apparel acts.The government gazette is the official channel for the publication of mourning apparel acts,almost all kinds of mourning apparel acts are published,and the relevant mourning apparel acts are also selectively reproduced in local gazettes and mainstream magazines.Liangyou,Zhonghua for man's wear and Shanghai pictorial magazine for woman's wear are selected as the objects of pictures and texts published in to make statistics on relevant dressing conditions and analyze the implementation status of three basic laws and regulations.Historical data such as the questionnaire on the prohibition of woman's foot binding in each province reflect the implementation of the measures.Finally,this paper analyzes the ideological origin of the mourning apparel act from the perspectives of equality,practicality and industrial salvation.This paper focuses on the equality of the mourning apparel act,which includes the basic equality,the equality of officials and the equality between men and women.It can be concluded that the mourning apparel act of the Republic of China is formulated and promulgated theoretically on the basis of the humanistic spirit and the principle of equality.
