Study On The Restriction System Of Environmentalassessment Region From The Pespective Of Ecological Civilization

As one of the important systems established in the environmental protection law,the"Environmental Assessment Regional approval restriction system"is of great significance for strengthening the environmental protection consciousness of local governments at all levels,carrying out the environmental protection responsibility and promoting the construction of ecological civilization.In the face of increasingly severe ecological environment situation,the concept of ecological civilization has been greatly enriched and developed.Ecological civilization puts forward new requirements for the restriction system of environmental assessment region.In this paper,combining with the new requirements of ecological civilization construction,this paper analyzes the practical problems existing in this system in order to make it perfect,which is beneficial to the construction of ecological civilization and the construction of beautiful China.Promote the development of green economy,realize the harmonious symbiosis between man and nature.In the first part of this paper,the author firstly defines the concept of restriction of environmental impact assessment by theoretical research and legal regulation,and defines it as the regional limit approval of environmental impact assessment documents for construction projects which only suspend approval of the total amount of new key pollutant emissions.Secondly,the nature of the act is defined,the author thinks that it belongs to the abstract administrative act,and finally summarizes its legislative process.In the second part of this paper,from the connotation of ecological civilization,combined with the ecological legislation and new requirements to explore the ecological requirements of the environmental assessment system,the main performance is that the content of the system should highlight the environmental quality doctrine.The implementation of the system should achieve fine governance,and this is refined.In the third part of this paper,the author carries on the empirical analysis to the environmental assessment region limit batch system,has carried on the summary to the environmental protection department of all levels since the environmental protection department issued more than 300 cases since the implementation of the environmental assessment region restriction batch,from the limited batch times,the limited batch scope,the limited approval main body,The limited batch time and other aspects of the comparative study,and then combined with the case found that the existing problems in practice are mainly focused on:the main body of the limited batch is confused,the provisions of the limited batch situation is vague,and the implementation procedure is not perfect.And the approval limit period is not one.In the fourth part of this paper,aiming at the deficiency of the restriction of the environmental assessment region,the corresponding suggestions are put forward to realize the ecological management of the limited batch of the environmental assessment region according to the new requirements of the construction of the ecological civilization.
