Research On The Rule Of Law Of Environmental Provection Movement

There are two ways of governance: constant governance and sport governance.From the perspective of Chinese history,sports governance has always existed.Whether in the feudal period or after the founding of the People's Republic,it is often the top-down mobilization to start a series of political,economic,cultural,ecological governance,rectification,law enforcement and other activities.Constant governance,as a basic way of governance,plays its due role in institutional governance,while sport governance is generally used as a supplement to the failure of institutional governance.As a supplement to the stability of bureaucratic governance,sport governance should appear less.But after the founding of New China,especially since the reform and opening up,with the continuous expansion of the scale of national governance,new problems and new situations in the period of social transformation,sports governance has been used more and more.Whether it is the "anti-black and anti-evil" action at the national level or the special rectification in grass-roots society,sports-based governance has become a trend and a normal means,as well as in the field of environmental protection.China has formed a relatively complete government-led environmental governance system,but in recent years,due to the "GDP" theory in the process of economic development,backward industrial system and lack of awareness of environmental protection,China has not been able to get rid of the "pollution first,then governance" road.With the increasingly serious environmental pollution and the insufficiency of conventional treatment,more and more sport-based treatment methods are adopted in the field of environmental protection.Central inspectors,air pollution patrols,looking back and other sport-based governance has become the most frequently used way of governance.At present,there is a consensus in academia that sport governance should not be advocated,but in fact,sport governance has its incomparable advantages in the process of social transformation,and Sport governance will still exist for a long time.Whether sport governance and constant governance should be separated,or whether the variable of sport governance can be transformed into constant in the process of governance,turning centralized and wave governance in a period of time to bureaucratic-based conventional governance,and fixing it with system,at the same time providing legal support for it.It can not only overcome the failure of conventional governance,but also give full play to the advantages of sports governance,and further reduce the emergence of sports governance.This paper is divided into five parts:This paper chooses the campaign governance of environmental protection supervision in Linqing City of Shandong Province in 2017 as the research object.Based on the investigation of the process of the campaign governance of environmental protection supervision in Linqing City,this paper analyses that the campaign governance is effective in the short term,but can not be used for a long time,can not solve the fundamental problems,and should take a road of legalization.Firstly,the research data of sport governance at home and abroad are sorted out,and the different stages of sport governance research and the route of its transformation are obtained.This paper defines the concepts of sports governance,rule of law and environmental protection,and expounds the basic principles that should be adhered to in the legalization of environmental protection.Secondly,the author conducted a survey of Linqing City,Shandong Province,and summed up the process of three environmental protection campaigns in Linqing City.Throughinvestigation,the achievements of the campaign governance of environmental protection supervision in Linqing City and the problems arising from the campaign governance of environmental protection were obtained.The advantages and disadvantages of the campaign governance were analyzed.After that,the reasons for the problems of sports governance are analyzed.By comparing the causes of the problems of sports governance of environmental protection with the causes of environmental pollution problems before sports governance,it is concluded that the root cause of environmental pollution problems lies in the low level of legalization in the field of environmental protection.Finally,according to the existing governance problems,from the angle of law enforcement,legislation and judicial,this paper puts forward the transformation path from environmental protection campaign governance to environmental protection rule by law governance.
