Study On Administrative And Legal Responsibilities Of River System In China

In recent years,due to the development of industry and the increase of population,the water ecological environment of our country has been seriously damaged.Governments around the country have taken various measures to solve the problem of water pollution,but the effect is always unsatisfactory.In 2007,Wuxi City of Jiangsu Province took the lead in establishing the "river system" in the face of the large-scale pollution of Taihu Lake caused by the outbreak of cyanobacteria.River system is a system innovation with Chinese characteristics.Its essence is a form of responsibility for water environment initiated by local party and government leaders in our country.The core is responsibility to people.The system of river length clearly defines the responsibility system of the chief executive,which tightly holds the "bull nose" of the local party and government leaders to bear environmental responsibility,links the control of river pollution with the promotion of the party and government Leaders' achievements and economic benefits.At the same time,it also enables all water control departments under the unified leadership of the local party and government leaders to take overall consideration,division of labor and cooperation,and assume their respective responsibilities,thus resolving the "Kowloon Rule".The problem of "water" and the effective platform of social co-governance are constructed to ensure that the river environmental protection work receives twice the result with half the effort.In 2016,the Central Committee issued the Opinions on the Comprehensive Implementation of River system,which stipulated the river system at the national level and required that the four-level river system be built in an all-round way by the end of 2018.The river system not only embodies the existing water resources management system in China,but also tortures the existing legal system.At present,the development of river system in China has entered a new stage,but there are still some problems to be solved urgently.For example,there are serious deficiencies in legislative protection,inadequate law enforcement and supervision,unclear responsibility system,imperfect evaluation reward and punishment mechanism,poor cohesion among regions or departments,formalism,poor publicity effect of the government,which lead to inadequate public participation.Therefore,we urgently need to construct a perfect legal mechanism to determine and quantify the administrative and legal responsibilities of the "river leaders",clarify the rights,responsibilities and interests of local party and government leaders,and provide the basis and guarantee for the long-term and effective promotion of the river system.This paper elaborates on the pilot model of river system in China and successful cases of river regulation abroad,summarizes the existingproblems in administrative responsibility and legal responsibility of river system in China,and puts forward several suggestions to improve river system from the perspective of responsibility,which provides a reference for the full implementation of river system.
