Study On The Administrative Accountability System Of The Min River Basin’s Aqueous Environment Protection

China has already entered the period of high pollution, and the pollutionincidents of the Min River’s aqueous environment in Fujian Province, whichrestricted the sustainable socio-economic development of Fujian Province gradually,also occurred frequently. As the “Accountability Storm” sweeping China, theenvironmental protection domain started to explore “Administrative Accountability ofthe Environmental Protection”. In terms of the field of the environmental protectionof Fujian Province, the protection of the Min River Basin’s aqueous environment isthe most important one among the environmental protection tasks for the governmentand officials at all levels in Fujian Province, at the same time, the administrativeaccountability system of the Min River Basin’s aqueous environment is an importantsystem guarantee for implementing the government’s environmental responsibility.This paper firstly analysis the strategic significance of the Min River Basin in thesocial development and the economic construction of Fujian Province, as well as thegovernment at all levels plays an important role in the aqueous environmentprotection of the Min River Basin, in order to implement the government’sresponsibility in managing and protecting the aqueous environment of the Min RiverBasin and to realize the efficient protection of its aqeous environment,the authorthinks a set of administrative accountability of the aqeous environmental protectionfor the Min River Basin should be established as soon as possible.On the basis of analyzing the different definitions of the“Accountability”、”Administrative Accountability” by the scholars, this paperprescribes the concepts of “Accountability”、”Administrative Accountability” and“Administrative Accountability of the Environmental Protection” firstly, then studiesthe practice situation of the regulations and systems,which related to theadministrative accountability system of aqueous environmental protection in FujianProvince. For there is no regulations for administrative accountability ofenvironmental protection in China’s current law, and the Regulations of Protecting theBasin Water Environment in Fujian(Draft) which issued in2009also ignored theregulations of the environmental protection administrative accountability. Also, the situation of confusing、 overlapping responsibility and authority among thegovernment department existed in the field of protecting aqueous environment inChina, led to the various situation such as ineffective implementation of theaccountability system, inadequate and inappropriate investigation of the liability etc.In addition to the imperfect relevant supporting system for the administrativeaccountability, the practice effect of the environmental protection administrativeaccountability was greatly reduced. Therefore, the author proposes the suggestions onconstructing the administrative accountability system of Min River Basin’s aqueousenvironmental protection.While constructing the system, we should reshape the culture of administrativeaccountability and start from the elements of administrative accountability, that is,establish regulations about the accountability subject、 accountability object、accountability scope、 accountability procedures and responsibility system, etc.Administrative accountability of the environmental protection is multi-accountability,which including homebody accountability and allogeneic accountability. Comparedwith homebody accountability, the allegoric accountability is the one who reflectdemocracy better and supervise whether the government fulfills its correspondingresponsibility of environmental protection more effective, therefore, theadministrative accountability of the environmental protection shall enhance theallergenic accountability, including the accountability of authority, public andjudiciary. Finally, the supporting system for the accountability should be improved toguarantee the successful implementation of the administrative accountability of MinRiver’s aqueous environmental protection, achieve the goal of protecting the MinRiver’s aqueous environment ultimately, and realize the harmonious development ofsociety, economy and environment in Fujian Province.
