Research On The Vertical Reform Of Monitoring And Law Enforcement Surpervision System In Chongqing Environmental Protection Organizations

It is the 40 th anniversary of the reform and open in 2018 of China,after 40 years of reform and opening up,China’s economic and social development made a great progress but at the expense of ecological environment,the environmental pollution becomes a serious and universal problem in people’s daily life and work.Similarly,this is also a prominent short board of our country in building a well-off society in an all-round way.The main reason for this phenomenon is that some local governments and departments have deviated from the understanding of economic development and environmental protection,and the local government’s protectionism is seriously harmful.To thoroughly change this situation,it is necessary for the government departments to start with the supervision and enforcement system of environmental protection,carry out a radical reform,take improving the overall quality of the environment as the key point,solve the system and institutional obstacles to the implementation of environmental supervision functions,and make environmental regulation a reality.At the Fifth Plenary Session of the Eighteenth Central Committee of the Party,the Central Committee decided to implement the reform of the vertical management system of monitoring,supervision and law enforcement of environmental protection institutions under the provincial level.General secretary Xi Jinping stressed that the reform should be carried out on a pilot basis.In September 2016,the Central Committee and the State Council issued a programmatic document entitled "Guiding Opinions on the Pilot Reform of the Vertical Management System for Monitoring,Supervising and Enforcing the Law by Environmental Protection Institutions under the Provincial Level".Chongqing was identified as one of the first two pilot provinces and cities in China.Municipal Party committees and municipal governments attach great importance to it,proposed that Chongqing should carry out the pilot reform of the vertical management system of monitoring,supervision and law enforcement of environmental protection institutions below the municipal level.At the same time,in the work report of Chongqing Municipal Government in 2016,the implementation of environmental monitoring and law enforcement at the municipal level of vertical management,strengthen organizational leadership,closely combined with the reality of Chongqing,scientific planning,accurate strength,strengthen overall planning,as the city’s key reform tasks to be promoted.This time,the article studies the vertical reform of environmental monitoring,supervision and law enforcement system in Chongqing,analyzes the traditional framework and power division of environmental protection management system in Chongqing,and points out that it is difficult to implement and monitor the environmental protection responsibility of the environmental management system in Chongqing before the implementation of the vertical management system reform of environmental institutions.There are many problems,such as the obstruction of supervision and law enforcement,the incomplete supervision system of environmental protection,and the lack of standardization in the construction of environmental protection organizations.At the same time,starting from the work of implementing the reform of environmental management system,the paper systematically analyzes the matters needing attention in the process of implementing the reform,and holds that the reform of environmental protection management system should always adhere to the problem-oriented,properly handle the relationship between blocks,vertical and horizontal,and systematically grasp the spirit of the central government in the reform of environmental protection system.It is not operational and effective,and can not be reformed for reform.At the specific operational level,the reform of the vertical management system of environmental monitoring and supervision should avoid the mechanization of the overall income,retain the support of the district and county Party Committee governments in fulfilling their environmental protection responsibilities;truly realize the separation of environmental monitoring and law enforcement functions,and solve the basis and system problems of environmental protection departments’ supervision;and strengthen the township environmental protection in Chongqing.To ensure that environmental monitoring,supervision and law enforcement work can be carried out independently,the construction of protection institutions and environmental protection personnel team.In this way,in the course of the vertical transformation of the environmental monitoring,supervision and law enforcement system in Chongqing,we can accurately set up the dual management system of the combination of sections according to the requirements of the central government,and form the environmental monitoring system with clear powers for other provinces(especially the municipalities directly under the Central Government).To carry out this function change and provide feasible experience and play a tagging significance.
