Research On The Perfection Of The Legal System Of The Response To The Emergency Environmental Incidents

The water pollution incident which happened in Lanzhou,Gansu on April 11th2014 arose attention of all citizens at that time.While the frequency of such emergent water pollution incidents has not been decreasing but increasing for the past few years.And it has become an important factor that contributes to the instability of our society for that the pollution not only caused great damage to the environment but also did harm to peoples' health.However,construction of legal system for emergent environmental incidents in China started late and even now is still lagging behind compared with other environmental laws,which inevitably leads to various problems while dealing with emergent environmental events.Therefore,the author thought it is important to discuss the deficiencies of the existing legal system for emergent environmental incidents in China and put forward corresponding measures to improve it.The article includes four parts.In the first part,the research background and significance were introduced and the situation of researches on both domestic and foreign reactions for emergent environmental incidents was summarized through literature review.Meanwhile,relevant concepts and characteristics of response to emergent environmental events were defined and analyzed.In the second part,existing problems of our legal system for emergent environmental incidents and possible causes were analyzed.Taking the water pollution incident in Lanzhou as a point to start,this paper analyzed and summarized problems reflected by the incident from the legal perspective,namely,the problems include insufficient supervision,the lag of information disclosure,the lack of public participation,the difficulty in solving accountabilityand relief and inadequate emergency support.It aims to reveal the deficiencies of our legal system and analyze the reasons.In the third part,the author summarized advanced foreign experience dealing with emergent environmental events and generalized the implications to solve the problems in our legal system for emergent environmental incidents,such as the specialization of emergency institutions,the specialization of emergency personnel,the participation of the whole society,and the high attention to emergency education and emergency rehearsal,etc.All of these provide reliable references for the development of legal system for emergent environmental accidents in China.In the fourth part,corresponding measures and suggestions on the above problems were put forward respectively on the basis of previous analysis according to China's national conditions and the advanced experience of certain developed countries.
