The Legal Regulating Of The Socialization Of Environmental Monitoring

Along with our country environmental monitoring task volume increasing,as well as to the requirement of environmental monitoring is increasing,the original environmental monitoring station as the center of government monitoring mode was difficult to competent for the current heavy environmental monitoring work.After China’s accession to the WTO,more and more social environmental monitoring institutions have appeared in China,and environmental monitoring has started to become social.Socialization of environmental monitoring means introducing the social institutions to enter the market,the government directly provides environmental monitoring service patterns into social institutions to purchase monitoring services to the government,to break the government monopoly form,makes the market more competitive,diversified environmental monitoring.Present socialization of environmental monitoring is still in a preliminary stage of development,although the state and the provinces and cities in order to make social environment monitoring institutions more standard operations are introduced relevant legal norms,these files are generally to its market access,monitoring,operation management and supervision of sanctions provisions,but the legislation still exist many defects,such as high market access threshold,set unreasonable,monitoring area of the opening range is narrow,operation supervision system has not yet formed,poor performance of supervision and sanctions,etc.,aiming at these situations,the author thinks that to reasonably determine barriers to entry,orderly open monitoring business,strengthening the operation supervision system,the perfection of the mechanism of supervision and sanctions from several aspects to improve the legislation,so that they can better and more long-term standardize the operation of the social environment monitoring institutions,to better promote the process of our modernization ofenvironmental monitoring.
