Research On Endangered Wildlife Crime In China

Wildlife is the friend that coexists with human beings.Active protection of wildlife to save endangered species is not only of great significance for safeguarding ecological civilization and biodiversity,but also an inevitable requirement for improving national biological security.In recent years,due to the undiminished social demand for endangered wildlife resources,as well as the difficulties in prevention and control of the diversification and concealment of illegal poaching trade and other criminal behaviors.The criminal trend of destroying endangered wildlife resources in China has never been effectively curtailed.From the perspective of criminology,this paper aims to clarify the phenomenon of crime,deconstruct the causes of crime and put forward prevention and control countermeasures.Through systematic literature review and comparative study,the relevant research results were absorbed to clarify policies and regulations.Through the data analysis and case study of 2,945 criminal judgments from 2016 to 2018,and combined with the combat and governance experience of frontline law enforcement personnel.In this paper,the causes and prevention and control countermeasures of the crime of destroying endangered wildlife resources in China are studied.This paper firstly defines the concept of the endangered wildlife resources crime,sorts out the legal regulations,and expounds the criminal harm.According to the judgment,summarizes the present situation of the crime,the subject of the crime,the space of the crime,the way of the crime and the characteristics of the object of the crime.According to the criminal motive and behavior characteristics,this paper sums up three typical criminal forms,individual exploitation,domestic operation and cross-border smuggling.The factors affecting the occurrence of crime are analyzed from the social and individual levels,it is found that the lack of awareness of wildlife protection leads to the weak power to curb crimes due to the poor effect of public right regulation.On this basis and focus on the whole process of crime,puts forward some preventive measures to promote the consciousness of protection,standardize industrial development and realize social co-governance.In order to improve the crime fighting and supervision system in the crime prevention countermeasures,with strict criminal law net to improve the punishment and prevention effect in crime prevention countermeasures.
