| As an important natural resource,cultivated land has great value in social,economic and environmental aspects.China's economy is in the process of rapid development,but it also makes the area and quality of cultivated land continue to decline,which will directly threaten China's food security and social stability.Gansu's ecological environment is fragile,and the reserve cultivated land resources are relatively scarce.A certain amount and quality of cultivated land is of great significance to the ecological environment of Gansu.At present,the use of cultivated land in Gansu is extensive,and the problems such as abandoned land are more prominent.The waste of cultivated land is serious.Apart from national policies and some local economic means,there is no corresponding legal protection measures,which leads to the lack of legal measures in the protection of cultivated land.Law production is one of the most important means of arable land protection,and it has an irreplaceable role.Under the general environment of ruling the country according to law,the problems related to arable land protection must rise to the legal level,so that the protection of cultivated land can be based on laws and conflicts between people and land.Today,the mitigation and resolution of conflicts between people and land depends on the law.Therefore,studying the legal protection of cultivated land is necessary for the effective and rational use of cultivated land resources.Through empirical research,it is proposed to improve the legal measures related to the protection of cultivated land,and to contribute to the development of China's farmland protection laws.As a typical area of rural outflows and cultivated land in Gansu Province,Beishan in Yuzhong is of great significance for investigating the utilization of cultivated land and proposing perfect suggestions from the legal system.In addition,the terraced fields have been reconstructed on the steep slopes of Beishan,but there are no documents on how to use them at the county level.At the same time,there are too few regulations on the use of cultivated land in Lanzhou and even in the middle of Yunnan,and the lack of regulations on cultivated land,land,forests and land transfer.As a result,the problem of the reclamation of Beishan has not been alleviated.Therefore,this paper will focus on the protection of cultivated land in the Beishan area and make recommendations on the legislation of farmland protection in Gansu.This paper is divided into four chapters.Based on the current situation of cultivated land resource utilization and legal protection,based on the investigation and study of cultivated land use in Beishan,the paper evaluates the legal evaluation of cultivated land protection in China and puts forward relevant suggestions for improvement.At the same time,the article aims to point out the importance of the legal protection of cultivated land resources for the rational use of cultivated land in the Beishan.The field research and theory are combined to conduct field research on the utilization of cultivated land resources in Beishan and analyze the reasons for the shortage of cultivated land.Find out the problems of arable land circulation,returning farmland to forests and management.It also evaluates the relevant laws and regulations of China,and at the same time,explores the legislative protection of cultivated land in China,the protection of cultivated land system and legislative protection in China,draws on effective foreign experience,and discusses the norms of cultivated land protection in other provinces in China.In practice,the best practice is to put forward relevant suggestions on the current legislation of farmland protection in China,analyze the legal protection countermeasures to deal with the bottleneck of farmland protection in Beishan,and explore the legal protection contents of cultivated land in Gansu and Lanzhou respectively,combined with local conditions.Relevant regulations put forward specific suggestions for improvement. |
