In the past,the separation of legislative authority between the central and the state has been an important issue in the study of the constitutional law,the institutional issue facing constitutional practice.It is essential to determine that criteria for the division of legislative authority in the central and local areas,so that the central and local legislation can be clearly demarcate only if the boundaries and limits of the central and local legislation are clearly defined.There are two typical academic views on the demarcation standard between the central and local legislative powers,namely,"Importance" and "Reach".The current law of China adopts the former for the division standard of the central and local legislative authority,while the most typical example of the latter is the United States of federalism.With the progress of the society,the "Importance" has not been able to satisfy the demand of China's legislative practice,and a number of problems have arisen in the process of dividing the national central and local legislative authorities.Based on the game is remarkable in the central and local legislation purview division of mineral resources,for example,to our central and local legislation purview division standard for research.With the legislative items attributes as the central and local legislation purview division standards,in the "Importance" and "Reach" the benefits of still makes up the defect of the existing theory at the same time.We can effectively deal with the problems that exist in the legislation of our mineral resources legislation in our country,and the laws of overstepping and the legislation of the law,and the problem with the position laws,and we're going to provide a new way of thinking about the central and local legislation of the central and local legislation.
