Innovation Efficiency Of Patent Pool With Different Governance Modes

In the era of economic globalization,scientific and technological innovation ability become one of the best key embodiment of enterprise strength.An enterprise which has strong scientific and technological innovation ability can get a higher position along the world industry chain,push its development and get important proprietary intellectual property rights which helps it leading the social development.In order to improve the scientific and technological innovation ability and enhance competitiveness,many high-tech enterprises change competitive strategy from "fight separately" become "win-win cooperation".They gain sustainable competitive advantage through the formation of patent pool.The patent pool saves transaction cost and reduces patent litigation and patent disputes through patent package licensing and joint authorization,which improves its innovation ability and core competence.However,the development of patent pool of our country starts late,the governance mode of patent pool is not mature enough and we also lack of constructive guidance theory,these all make it difficult to form independent advantage in international standard competition.Therefore,the research on governance mode of patent pool is significant for promoting the forming and governance of patent pool in our country and elevating our international voice and competitiveness in area of patent pool.In this paper,we introduce the connotation of patent pool governance mode,classification and development motivation,analyze power and benefit allocation mode of patent pool,put forward three evaluation indexes of the innovation efficiency of patent pool and find out influence on patent pool efficiency by different power and benefit allocation modes.We get mpeg-2 and DVD6C patent pools as the research objects,make manual retrieval and computer processing on their data and do comparative study between mpeg-2 and DVD6C patent pool.We find that mpeg-2 patent pool is better than DVD6C patent pool on quality of patents and patent update ability,but worse on member innovation ability.The research results show that independent governance agency mode is beneficial for the improvement of patent quality and patent's updating,but bad for promoting member innovation ability.In the end,based on the theory and case study,we put forward some rationalization proposal on building and management of patent pool from enterprise and national level.
