New urbanization is one of the important contents of promoting the integration of urban and rural development of China.The orderly progress of new urbanization will be bound to promote the reform and perfection of the legal system concerning the transfer of rural land property right,which will in return further deepen new urbanization.As an important part of rural land property right,the use right of collective land designated for business-related construction is a significant breakthrough of the market-oriented reform of collective land designated for business-related construction developed in the Third Plenary Session of the 18 th CPC Central Committee.In accordance with the planning and use control,implementing the equal availability of collective land designated for business-related construction and state-owned land in the market with the equal price and use right is an important attempt to break the dual structure of the urban and rural areas,which is also a requisite measure of promoting the equal exchange of urban and rural elements and the balanced allocation of public resources.In order to adapt to the development requirements of new urbanization,it is necessary to promote the reform of rural land system and improve the legal system concerning the transfer of rural land property right,especially the use right transfer of collective land designated for business-related construction.In this paper,new urbanization was regarded as the background of practice.Under the guidance of the rural land reform policies developed since the third Plenary Session of the 18 th CPC Central Committee,analysis was made on the current use right system of collective land designated for business-related construction in China,based on which the market legal system concerning the use right transfer of collective land designated for business-related construction was constructed and related suggestions to perfect the current situation were proposed.The main contents weredivided into the following four parts.Part 1: The overview of the relevant theories on the use right transfer of collective land designated for business-related construction.The main research object and the basic theory of the research were identified.Part 2: The changes and breakthroughs in use right transfer of collective land designated for business-related construction.The changes in the use right transfer system of collective land designated for business-related construction was briefly reviewed,related legislation and policy status was concluded,and the significance of the market-oriented reform of the use right transfer of collective land designated for business-related construction was expounded.Part 3: The practices and problems lying in the use right transfer of collective land designated for business-related construction.The basic situation of the use right transfer of collective land designated for business-related construction was introduced,the existing mode was summarized,and problems in the operation of the use right transfer of collective land designated for business-related construction was analyzed.Part 4: The path choice for perfecting the use right transfer system of collective land designated for business-related construction.This part mainly expounded how to establish the legal system concerning the use right transfer of collective land designated for business-related construction,including the improvement of the specific system and the perfection of the risk prevention and control systems.
