Game Analysis On The Interests Of The Main Body Of Collective Construction Land Use Right Transfer

As the basic system of our country,whether the land system is efficient or not has a great relationship with the social and economic development.The governments use the traditional land utilize model to protect the high rate of the national City and the high rate of industrialization and social development,but the segmentation between the market and the elements in the urban and rural areas,resulting in the distortions of the land price,which induced the expropriation impulse of the government expropriation,and frequent rent-seeking activities,finally leading to uncontrolled growth of the city,a substantial reduction in cultivated land area.Therefore,in the third Plenary Session of the 18th CPC Central Committee,it changes the operation mode of the right to the use of national collective construction land in the past,points out that under certain conditions,allowing the market circulation.To promote the right to the use of national collective construction land into the market,learn that the interest relationships among the participants in circulation is the prerequisite,and is the most important one.But at the current stage,due to the seriously lagging behind of the relevant policies and regulations and the circulation system of the right to the use of national collective construction land,cause the confusion of the interest relationship between the main body in the circulation of the internal collective land market.The appearance of these problems have seriously hindered the process that the right to the use of national collective construction land come into the market,and thus we should speed up to know clearly about the interests of various bodies in the process,lay the foundation for the perfect establishment of the collective land market.This research adopts the method of Literature method,normative research,logical analysis and so on,first of all,combing the concept of the transfer of the right to the use of collective construction land and its basic theory;secondly,this paper analyzes the interests of various subjects of the transfer of collective construction land use rights and their game relationship;thirdly,this paper have an in-depth theoretical analysis according to the previous model of the construction;fourth,summary the main body of the transfer in Sichuan Chengdu;finally,based on the basic principles of the right to the use of collective construction land transfer,in the interests of the right to the use of collective construction land transfer game analysis,the stability of the external environment of collective construction land,the protection of farmers'rights and interests,and the improvement of the supervision mechanism can promote the effective circulation of the collective construction land market.This paper found that the rights and interests of farmers is being lost in the transfer of the right to use the collective construction land,and the most vulnerable groups in the practice of circulation were not guaranteed.At the same time,the collective construction land use rights in the transfer of the various systems are not yet perfect,and it is led to the interests of the main body intensified in the collective construction land use rights.Therefore,this paper finally put forward three policy recommendations:(1)Based on the real estate registration,it will help clarify the relations of property rights.Registration of right certification is to avoid the risk,it is an effective way to ensure the effective transfer of the right to use collective construction land,and to ensure the integrity of the right to use collective construction land.(2)It is necessary to achieve the minimum living security system for farmers,By broadening the scope of protection,rural unemployment protection system and other systems.And we should also give a certain amount of subsidies to protect the lives of farmers who have no ability to work.(3)It is necessary to establish a clear trading license control system of collective construction land use rights transfer,and the formation of a legal basis.At the same time,we should broaden the channels of public supervision,and improve the disclosure degree and financial transparency of collective construction land use rights transfer information.
