Research On The Rule Of Law In China's Precise Poverty Alleviation

With the transformation of government functions from "power type" to "service type",the development of people's livelihood has become the top priority of our government work.Since 2003,a series of policies and documents related to poverty alleviation have been continuously issued.Precise poverty alleviation work is carried out in various provinces and cities in China.In the context of building a service-oriented government,the government's poverty alleviation and relief to the particular public can not be regarded as a kind of "gift",but should be a kind of duty and obligation.With the development of the economy and the development of the times,precision poverty alleviation is no longer the traditional sense of the scope and content of poverty alleviation,but to change the "blood transfusion" for "Hematopoietic",from the simple material to help the transformation of survival skills training,From the previous direct protection of the right to live directly to the protection of economic freedom first priority,the right to life protection of the transition and transformation.As a result of precision poverty alleviation to involve a large number of public financial funds,it is likely to become a "power to rent" to provide a breeding ground.Precise poverty alleviation is a formal administrative act,but in view of the relatively late development in our country,it is far less favorable than other administrative activities in China's administrative activities.The author puts forward some problems such as lack of administrative law enforcement,strict supervision and control mechanism,lack of relevant judicial relief mechanism and so on.In the practice of poverty alleviation work,because of the lack of legal protection mechanism,Lack of administrative organs to rely solely on policy services,power expansion,abuse of discretion to carry out corruption,pseudo-poverty,chaos poverty alleviation as abuse.In recent years,there are many scholars in China for poverty alleviationproblems in practice,put forward a lot of measures to solve,but in general,most of them are standing in the sociology and management point of view of policy analysis and administration to regulate,These problems simply can not really be resolved.At present,China's main goal is the construction of the rule of law,the use of the "rule of law" instead of "rule" to achieve effective management of the country,in view of this,China's precision poverty alleviation of the rule of law is particularly important.In this paper,from the perspective of power restriction and human rights protection,this paper makes a comprehensive analysis and prospect of precision poverty alleviation by means of empirical analysis,value analysis and normative analysis.It is mainly from the four aspects of legislation,law enforcement,supervision and judicial and the content is simple as follows:The first part is the introduction,which mainly introduces the research background,the research situation at home and abroad,the research method,the innovation point and the deficiency and the basic definition of precision poverty alleviation.The second part is the status quo of the legalization of poverty alleviation.This paper makes an empirical study on the current situation of poverty alleviation in poverty-stricken counties in Henan Province.It is found that there are some problems such as lack of legislation on poverty alleviation,lack of administrative law enforcement,imperfect supervision and control mechanism and judicial relief mechanism.The third part is the analysis of the necessity of fine legalization of poverty alleviation.From the strategic positioning of the rule of law in China,the realistic requirements of the construction of the rule of law government,the government from the power of government to the service-oriented government to change the inherent needs of human rights protection of the pursuit of four aspects to explain the standardization of poverty alleviation of the increasingly prominent value andsignificance.The fourth part is the basic principle of fine legalization of poverty alleviation.Through the principle of human rights
