Employment insurance is an important part of social security system,which is a insurance policyprotecting occupational safety, playing a huge role in maint-aininglegalrights between employers and employees. Employment insurance demonstratesasystemofthreeparts,that is precaution-recovery- compensation, protecting employees before accident, during accident and after accident. But in practice, both employers and employees usually ignore precauti- on, despise rec- overy but focus on compensation, thus disability evaluation, which is key factor related with compensation,attracts too much attention. Disability evaluation after employment injury is fundamental for compensation, and its conclusion di- rectly affects on the final value of compensation. So there is a practical demand to study on the present situation and problems with disability evaluation, to ana- lyze causes to such problems and to propose methods to improve disability eval- uation.The disability evaluation system in China shapes together with social sec- urity laws and regulations and it starts relatively late,gradually becoming matu- red by experiencing practice judgement.This essay studies on employment insur- ance policy in and out of China combined with present situation of disability eva- luation in changzhou city, and concludes problems with evaluation system,evaluation policy and evaluation standard.This essay studies on 16000 employm- ent injury cases in changzhou city between 2015 and 2016, analyzing in accident type,injury sort,disability level and re-evaluation etc..concluding problems and troubles in practical operation of disability evaluation such as policy deficiency, simplex method, non-standard procedure,and absent standard etc.. The essay is also based on talks with some evaluation specialists stating problems and deficie- ncies from their point views.Finallytheessayproposestoimprove disability eva-luation by consummating system, policy and standard, to strengthen 3 in 1 insu- rance frame to consummate whole system; to establish injury stability period re- ference system, design scientific evaluation principles,optimize site management policies, strengthen specialist teammanagement to consummate whole policy. By such means, the essay aims to protect legal rights for both employers and employees with more precise and objective injury evaluation.
