With the growing influence on economic development, social democracy, culture integration and national security, cyberspace has become the fifth sovereignty after land, sea,sky and outer space. As an emerging field in global governance, It is now an important strategic point which all counties are competing for. There are lots of problems needed to be solved, although China is on an express lane of legal system construction in cyberspace. First of all, legal system is uncompleted. Cyberspace legislation lacks of foresight, authenticity and system. Second, governance theory is lagging behind. Control measures are used more in cyberspace, following the traditional way. The government is weak in legal conception,service duty and system construction, and always playing the role of administrator and taking charge of the negative situation rather than the role of providers.This paper consists of four chapters: Chapter 1,mainly talks about the background and significance of the paper, current research in the domestic and overseas, and the way to research. Chapter 2, mainly talks about the development of cyberspace and its governance.Chapter 3, mainly talks about the necessity of promoting the rule of law in cyberspace.Chapter 4, mainly talks about the path choice of promoting the rule of law in the cyberspace of our country. This paper attempts to analyze the current management system, and to sort out the laws and regulations of cyberspace governance, to clear the achievements and shortcomings at the present stage, in order to find a way to meet the development of cyberspace governance in China.
