In The Tongzhi Period, The "Declaration" Published The Study Of Legal Materials

Before the nineteenth Century,China has inherited the ancient traditional legal system,it is different from the western legal system due to the differences of the times and regions.However,this tradition has changed in the late Qing Dynasty,the ancient Chinese legal system suffered the fate of collapse.The reason for this result is diversified,and the reform in late Qing Dynasty is an important event in China legal history,its influence still exists,therefore,a comprehensive and in-depth understanding of the process of reform in the late Qing Dynasty is an important topic of China legal history research.The "Declaration" is one of the earliest newspapers to be released by China,about twenty-five thousand editions,from April 30,1872(Tongzhi eleven years in March 23rd),to May 27,1949 when Shanghai was liberated."Declaration" is the first hand information to understand the modern history of China,which contains a wealth of information content,covering all aspects of social,economic,legal,political.At present,the results,on researching China legal history of late Qing Dynasty,are mainly concentrated in the period after 1895 and less in Tongzhi period.Ignoring every detail will cause misunderstanding and deviation on knowing the real process of reform.Because of the limitation of time and my abllities,In this paper,I try legal information collation of Tongzhi period "Declaration",as the object of research and analysis,Try to analyze,during the Tong zhi period,the relevant legal systems,the practice of judicature,the influence of western legal culture on Chinese society,the change of public opinion in society and the status and function of these things in the whole process of reform.This article is divided into four parts,the first part of the introduction,is to introduce the reasons for choosing the topic,research status,primary coverage,the method and innovation of research;The second part briefly introduces the historical background of the Tongzhi period "Declaration" and specific content about the related legal documents of "Declaration";The third part is the analysis of legal information of Tongzhi period “Declaration”,from the perspective of legal history,tries to analyze,the legal information of Tongzhi period “Declaration”embodied,the legal system on relevant judicial practice and the western legal culture dissemination,The fourthpart is based on the analysis results of legal information of Tongzhi period“Declaration”,reveals the influence and effect of the western legal culture on the society at that time,and clarifies the Tongzhi period's status and function to the reform of late Qing Dynasty.
