Legislative Research On The Function Of Social Insurance Agencies

Social security in China has developed from labor insurance in era of planned economy which followed "efficiency priority and give consideration to justice" to social insurance in era of market economy which follows "people oriented and overall consideration".With that,law on social insurance also has been perfect and stipulates a unified social insurance system.To build a service-oriented government,it is essential for social insurance agency to follow regulations and agencies on social insurance and to manage the social insurance fund efficiently.However,there are still many problems such as having no definite function,and confusion in collection and management of social insurance fund and so on resulted from the fuzzy regulation of law on the nature of social insurance agency and system.Therefore,it is necessary to rebuild the system of function of social insurance in the legislative level.After the building of function of social insurance agency in legislative level,specify its rights,obligations and legal responsibilities on social management.This paper mainly maintains four parts.For part one,it is about analysis of field research on function of social insurance agency,including its fundamental functions and problems and so on.Part two is insufficiency of provisions of "Social Insurance Law" on function of social insurance agency,including social insurance agency’s function in law and its deficiency in legislative level.Part three is legislation and comment on social insurance agency in German,America and Chile.Part four is suggestion to perfect the legislation of function of social insurance agency in China.
